a o NN ___ines._But they do claim that by 1 DAILY TRANSCRIPT. “NEVADA CITY, CAL, “ in the upper-canyons. ~ France, killed 24 persons and inBusiness “a LeONARDS. SGALKING. ave de . Editor Nevada County a Press, ‘WEDNESDAY, APRIL 4. ALL THAT 18 CLAIMED. The Marysville Appeal comes to hand with another adverse criticiem of the Humbug Dam. A singular feature in the present controversy between the miners and the farmers, is that the latter appear to especially object to any attempt being made by the miners for the protection of the farming lands, They wish to ruin the mines, and they think they cannot succeed in doing this unless their lands are permitted to be destroyed. They therefore attempted to burn the brush dam that in 1880 saved Marysville from overflow, and now they make every effort to discourage the erection of debris retaining dams After the Judge Temple decision last Spring, the Bloomfield Company commenced the erection in Humbug "Creek of wartb dam to~-show~ the: practicability of such structures for storing the coarse debris from the mines, This dam was raised to a height of 52 feet. and now has lying behind it an enormous amount of gravel extending back half a mile. This dam was raised slowly as it filled with ‘tailings. No work has been done upon it for the past three months, ~ Since the cessation of work on the dam the greater portion of the debris from the mine hag flowed past and over it, making a large desposit in the river below which will be removed by the present high water ; but the vast-body of. gravel above will be permanently retained. There is no wear upon the dam excepting for a short distance on the crest and this is protected at a very trifling cost. It was built to show that at a not excessive cost structures could be built in the canons that would remines, ' The constructors of this dam make no pretense that it will retain all the gravel from the. hydraulic increasing the hight of this dam, and by the construction of similar ones at other points, the. requirements of Judge Temple’s decision will be fulfilled, and thus the farming land will be protected while the miners will be permitted to: pursue unvexed the production of the precious metal. We have always favored the construction of debris storage reservoirs upon the vast wastes where the rivers debouch upon the plains, but their erection in the mountain canons has the advantage that being under the guardianship of the miners, they will be safe from the incursions of the irate readers of the Appeal who, we fear, would take a malicious delight indestroying them even at the expense of bringing destruction upon their own property. Wale TS Mr. Junius Marcus, the gsntlemanly broker in whiskey in New ‘York, whose genius and talent, enabled him to acquire some fifty or more thousands of dollars of his clients’ money and get away with it and his family to Oregon, left San Francisco Sunday on his return trip, having been most outrageously interrupted in his peaceable pursuit. of ease and comfort by the disreputable officers of the law at Portland. . , Mr. Marcus will return to New York, however, with the dignity and style becoming a gentleman of his distinguished attainments. His suite for the journey consists of Mrs, Marcus, two very attractive children,a nurse, and a couple of minions of the law, who probably accompany him to see that no ignominy is -offeréd him on the route. It should be kept in mind'that Mr. Marcus is. no petty larceny thief, buta first-class swindler.
