The old-liners want the returned prodigals to-put themselves on probation for awhile, andthe latter not only refuse to so demean themselves but insist upon being~properly rewarded for coming back. There’s fun ahead. There is more or less fault-finding because the'County Board of .Equa-. lization expressed and had recorded its opinion of those hydranlic mine owners hiring Chinese, The more that mongolian labor in the mines is agitated against officially ‘and otherwise the sooner public opinion will become so strong that the Chinese lovers will be brought to terms in the interest of white labor. ee ee THE CUMMINGS CASE. The Papers Being Made Oat to Bring Patterson Here for Trial. Complaints have been filed in the Superior Court charging John C. Patterson and Charles Dorsey alias Moore with the murder of. William F. Cummings, on the Blue Tent road three miles above this city, in September, 1879, and also with robbing him of gold bullion and other effects aggregating in value $7,594. The complaints are sworn to by A. Nivens, Jr. The authorities will at once proceed to get out extradition papers, and within a few days detectives Lees and Aull of San Francisco: will start for St. Louis to secure Patter— son who is in custody there awaiting trial for burglary., He will be brought here and tried this Fall. Dorsey is still at large, but the detectives are industriously searching for him. He is thought to be outside the State. Fisherman’s Luck. Fishing is poor in most of the artificial lakes of the county. Parties recently returned from Bowman and Fordyce say it is almost ‘impossible to “‘get_ a bite”. now in either of those places, The trouble is that the water is too high, covering such large territories that the fish get all the insect. food they want, As the season advances the water will ‘be drawn off by the mining companies and in a couple of months the fish will be glad to get anything to stay their stomachs. And the instruction ato cheracter was properly rejected, The prosecution cannot . attack the character of a defendant until the defense has introduced evidence to establish his good character. When a defendant, charged with a criminal homicide, has been shown to be a quiet and peaceable man, his character is to be ‘considered by the jury in cunnection with the evidence and may weigh in the balance so as tocreate a reasunable doubt of his guilt. If in the absence of evidence on the subject the presumption of good character is to weigh as much in his favor. as affirmative proof of it, the necessity of proving good character would never arise; and the prosecution would frequently be in » worse case than if evidence of good character had been given— since the prosecution would be barred from introducing evidence to overcome the presumption. When it is said that good character is to be presumed it is only said that, in the absence of evidence, the jury should not attribute to defendant a general bad character with respect to the qualities involved iv the alleged offense, nor give weight to his assumed bad character in deevidence established his guilt. 4 McKinstry, J.
