executed and delivered to said plaintiff his
promissory note for the balance $1,855 gold
coin, with interest thereon at 10 per cent

the sum of $20 paid of the interest due on
said note. 5th. That on Oct, 18th, A. D
1878 said Derbec Blue Gravel Mining Company purchased the said mining’ ground
from said E. Derbec'and is now the owner
thereof, having purchased the same with the
full knowledge that said E. Derbee Rad not
paid the balance of said purchase money,and
that suid balance was still dne and unpaid
from said E. Derbec to said plaintiff. Wherefore plaintiff prays judgmept against said
