says that all county officers assume

The Big Lumber Suit,
A San Franciseo dispatch of Thursday gives the fo lowing particulars
regarding the trial of the case of
Seth Martin and D. W. Leach ys.
Oliver Lonkey and FE. R. Smith,
which has.gecupied a jury in the
United States Court since Wednesday of last week, and will not likely
be concluded for several days to
come: Plaintiffs were partners in the
ownership ofthe Banner Saw = Mill,
near Truckee, Nevada county. In
1375 they midé a written agreement
with the defendants to furtiish them
with some five million feet of luniber.
This action was brought to recover
some: $60,000 damages for a non-performance of the contract on the part
of the defendants, It is elaimed by
plaintiffs that the defendants threw
obstacles in their way which prevented them from fulli ling the. coutract,
by depriving them of the use of a
certain dam trom which they tloated
logs down to their mill, while the
defense is that the ‘plaintiffs ‘had
voluntarily notified the defendants
that they had surrendered the contract. A great deal of evidence has
been taken in reference to ‘the lumber delivered to plaintiffs not being
merchantable, but that the agent of
the defendants counted it and set
it aside as merchantable, which the
defense aver he was not authorized to
do, or, in other words, that he was
not authorized to accept the same,
only to tally it. Itis also clainved
by plaintiffs ‘that the defendants
sold them a halt interest in a ranch
anda water right, which enabled
‘hem to floxt logs through a flume
they constructed to their mill, but
that the defendants connived with
another party to tile a pre-emption
on the land, who in turn sold onehalf to plaintiffs.

Officer Scott met two well dressed
strangers on the street late the other night, and engaged in a conversation with them, They told him
they had just come over from Leadville.
“What kind of a placé is it ?” ask.

“Well,” responded one of them,
“it’s the infernalest spot on the face
of the earth. The atmosphere contains three per cent. of lead. Pneumonia’s raging. There are eight
grave diggers at work all the tinie,
and every man that can’t get something else to do, goes to making coffins. If a fellow stays there long
enough, he is sure to die.”
Mr, Scott expresses no donbt as to
the truth of the last sentence, but
