“SATURDAY, JULY 4, 1835.
AT VERDICT.
The verdict ofthe jury in the
case of the People against young
Spreckles is the latest evidence afforded that the people of California are not in sympathy with
the virulent style of journalism for
which the San Francisco Chronicle is notorious, Thejury-in acquit.
ting the defendant doubtless did
what nineteen out of twenty men
in Nevada county, or anywhere
~ g@lse in Califoraia, would have
_. done; not because people general:
lly indorse to any extent the arga-mentof the pistol, but because
they hate abusive personalities in
journalism. No one here acquaint.
ed with all the circumstances ex* ‘pected any other result of the trial
than that which transpired. The
"San Francisco Post, which is a
very fair-minded and intelligent
journal, makes some sensible remarks 6n thismatter. After ex“pressing a belief tliat the ‘verdict
, Was given on “‘general principles,’’
it says: ‘‘When Mr. De Young recovers from the mortification and
alarm naturally occasioned by this
verdict—which must at present
seem to him something like‘a formal declaration that he is not entitled to the protection of the law—
he will, if he be a ‘sensible man,
recognize and profit by the lesson
which the verdict teaches. He is
the proprietor of a journal that. is
in’ many respects admirable.—
Tt has a wide circulation, and, in
his hands, can be redeemed from
the single fault which has always
marred its management. This
fault has limited its influence, and
brought blovdy consequences upon its owners. We refer to its
habit.of dealing in offensive personalities. ‘Too often its criticisms
have been extremely abusive
and undisguisedly vindictive. For
the sort of attack upon motives
alich earactre Lt y
icle has been given, men_instinctively feel that the libel laws, civil
and criminal, do not furnish —adeRE
quate redress. They fealthatin a
quarrel between a private citizen
and a newspaper, the. private
citizens is at a disadvantage which
justifies him, morally if not legally, in going outside the law when
too hard pressed in the unequal
fight. The love of fair play is a
' stronger sentiment than reverence
for statutes. The Chronicle had
@ right to criticise the conduct. of
the Spreckleses,so far‘as that conduct affected the public, but it
had no right to pursue them with
sneers, inndendo andvenomous
denunciation. It turned criticism
into persecution, and, bavause it
thus so far forgot the proper restraints of decorous journalism,. it
awakened a public sentiment hostile to itself, instead of against the
victims of its malice. This. public sentiment found concrete. expression in -yesterday’s verdict.”’
