The Downieville Tribune Thursday has the following: The Cleveland and Sierra Hydraulic Mining Co., and the Sierra and Union Water Co,, whose claims embrace a large area of valuable placer mining yround in the vicinity of Scales Diggings, have consoli dated. The ground, heretofore worked. by the hydraulic process, is to be drifted. The gravel lead em braced in the consolidation 16 three miles in length and if it proves profitable as drifting ground, the whole distance will. eventually be worked. When the tunnel is run in a couple of thousand feet the cars will be operated with a cable and reel, upon the same principle as the gable street cars in San Francisco. The water used for thie purpose will also be used in washing the gravel, About 169 mei are employed at the Alaska mine, Pike City, 20 of them being engaged in getting out wood. The water in the mine is under complete control. The company will soon put in » Worthing ton compound pump with a capacity of 1,000,000 gallons in twenty-four hours, It will raise water from the bottom of the mine—500 feet—in a angle stroke. The twenty-stamp mill is running Gonstantly with good results; the yield of the ore beiaz more thaq sufficient to meet all of the expenses of the mine. Col. E. P. Bates has succeeded Mr. Davis as Superintendent. The Grass Vailey Union says; The Capital Cricket Ciub of Nevada City is rather premature in claiming the champiwnsbip of the Pacific coast, as stated by the TRANScRIPT of yesterday. ‘The Union Cluv has played three friendly games with the Merien Clab of Sau Fraucisco, and one with the Occiaents, of that city, out of which they were beaten three aud won one, and there was 00 pretense that they were play‘ng even ior the championship of the State, The Unions have played tive games with the Capital Club— two match games, one at the District Fair, iu which they were vietors, and the one last Sunday in which they were beaten—The other three games were merely © practice games, with such menas, coul: be picked up at the time, Out of these threethe Univns were victorivus in (wo, 80 16 igedoubtful if the Capital Club can claim much championship from this. Since then they have steadily improved and are now more expert than the Merions, an the result of) the last game between the two elev-ns indicated, The Capital Club ‘nag not sinve ite organization been tefeated by the Unions. Some time ago a picked-up eleven from Nevada City—some of whom bad never play‘dut the game more than once or twiceand others of whom bad not handled a bat or ball before since coming from the old country years ago—was beaten by the Unions. We do not want any credit giveu to the Capitals that they are not hon" estly entitled to, but they have fairly won the first place among the clubs of the State and if they continue in practic: can keep __ it. Whether they will consent to play sny more match games before next spring, we cannot say until they have had a meeting. The Examiner says: The decision of Judge Temple in the mining-debris case of the People vs. the Gold Run Ditch and Mining Cumpany bas been affirmed in ‘he Supreme Court and perpetual injunction against. the defendants granted, The appeal was . taken on an order denying. a motion for a new trial and from a judgment which perpetually restrains the com. pany and compels the discontinuance of certain privileges as wrongful and injurious to public rights, Justice McKee, in his opinion, says: “All the questions involved in this case flow into one ss the main question at iseue,and that is, whether the defendant, as owner of its hydraulic mines situated on the banks of the American River, which empties its waters into the Sacramento River— the principal navigable river in the State—has the right to dump its hydrulic debris into the river, to the endangerment of habitation and cultivation of large tracts of country and to the impairment of the navigation of the Sacramento River, ani it there exists no such right in the defendant, do the acts committed constitute a public nuisance which may be enjoined in an action in the name of the people of the State ?” After having stated that the dumping of debris into the rivers is founded on popular customs, the Court says: ‘‘A legitimate business founded on a local custom may grow into a force to threaten the safety of the: people and destruction to public and private rights, and when it develops into that condition, the custom upon which 11 was founded becomes unreasonable because dangerous to public and private rights and cannot be invoked to justify the continuance of the business in an unlawful manner. The rights of the people in the navigable rivers of the State are paramount and controlling. The State holds the absolute right to all navigable waters and the soils under them subject to any rights which may have been surrendered to the Federal Government. The soil ehe holds as trustee of a public trust for the benetit ef the people. Aa tothe claim of right derived from prescription and
the statnte of limitations, it is sufficent to say thata right to continue a public nuisance cannot be acquired by prescription, nor ean it be legalized by lapse of time.” Justices McKinstry, Sharpstein and Ross concur in a long opinion with the decision of Justice MuKee. A counter appeal from the last clause of Judye Temple's decision has been reversed, Judge Temple, in his judgment, said that the defendant may apply to the Court to have the d cree and restraining order moditied, vacated or set aside. ~ Justice McKee, in his opinion,says that the perpetual injunction does not restrain the defendant from conducting its business in a lawful manner, and avy means adupted to that end are ‘lawful. Justices Myrick, Morrison and Chornton concur in thi» decision, while _. Justices Sharpstein, Russ and McKinstry dissent. The Supreme Court hasalso affirm ed the order of the injunction in the debris case of Hobbs vs. the Amador and Saciamento Canal Company etal. Inits decision the Court said: It is no part of the general and ordi_. nary business of a corporation to do unlawful acts. Acts which are of a continuousnature and threaten to destroy or irreparably injure the property of another, are unlawful and enjoinable at the suit of the person injured not upon the ground of interfering with a lawful business, but upon the ground that every person is entitled to the protection of the law in the ‘use and enjoyment of his property. Butit isclaimed that the doing . of the acts restrained by the injunction are necessary to the successtul carrying out of the business in which ‘the defendant is engaged; and that if the defendant be enjoined from carrying en its business that way, hydraulic mining cannot be. carried on atall. Yet the acts restrained are none the less unlawful if they are injurious to the private rights of othere; and the defendant is bound by law to so conduct its business ds that it shall not be derogatory tothe private rights of other preperty-owners, No person, natural or artificial, has a right, directly or indirectly, to cover his neighbor’s land with mining debris, sand. and gravel, or other material, 89 as torender it valueless.’ — Dow’t forget that J.
