WueErE ARE MORTGAGES TAXARLE?
—IMPORTANT Case: — An important
. ase, involving the question whether
mortgages are taxabié where the property is or where the holder ef the mortGage resides, was tried in the District
Court, before Judge McFarland, yesterday. The facts are these : James Whartenby holds mortgages on property in
San Francisco, to the amount of $112,000. Mortgages made there have,
usually,a clause binding the mortgagor
to pay taxes, and therefore, Mr, Whartenby,though adefendant, is not affected
individually by the decision. These
mortgages have all been taxed in San
Francisco and have. also been taxed in
this county, Mr. Whartenby being a
resident. San Francisco claims that
the mortgages are taxable there, and
Nevada county that they are taxable
where the holder resides. Suit was
brought by this county for the taxes, J.
BR, MeConnell appearing for plaintiff,
and Judge Niles for defendant: The
ase Was yesterday submitted, and .decided by Judge ‘MeFarland in favor of
the county, he holding that mortgages
are taxable where the mortgagor resider.
Tlie case will be taken to the Supreme
Court where this question will be fully
settled. “If Judge McFarland’s decision
is sustained it will make ‘quite a difference in favor.of outside counties, as
much capital of the interior is invested
dn mortgages: in San Francisco. ‘To
‘Nevada cbunty alone it will make a dif‘ference of several hundred thousand
dollars inthe assessment roll.
‘THe Berrixe Casss.—Two betting
gases have been decided in. the ‘District
Gourt, «In the case of Sandere vs.
Wobier, ‘the litter took an interest of
$200-in's five hundred dollar bet made
‘by Grieg. The latter, was. garnisheed
by Sanders, and notified Nesmith, the.
stake holder, to give up the money,
whi¢h he did, The case was decided
ageinst the plaintiff, and the winaing
parties got the money. In the other
case, Dooling vs, McGrath, plaiatiff
gained the sult, This latter was a bet
of $500 a side,McGrath being the looser.
After election Dooling sold his saloon
‘to McGrath, and immediately attached
the stakes. The attachment was held
to.be good and the money given to
plaintiff, betting not being recognized
by law.
Cex: Fouances.-On the ist of May
"last the Board of 'Trastees entered upon the discharge of their duties and
the city debt amounted to $7 400, This
débt resdited from ‘the extraordinary
expense required for building and repairing bridges. The tax had pre~
viously bees 70 cents on each $100, and
a bill.was passed by the last Legislature authorizing the city ‘to levy a
special tax of fifty cents for two years,
The Board of Trustees for the present
Year only levied a special tax of thirty
cents) making the total tax, including
the Fire Fand tax $1'00 on each $100.
It is. now estimated that the debt will
be reduced to $1,500 by.the first of May
next, and the Trustees are confident
that in anotheriyear they will be able
without levying any special tax to pay
ae entirely, and have. surplus
‘to conduct the city affairs on a

© with strict economy the affairs of the
town ‘and to protect the interests of
