The conflict between miners and agrioyltarists io California, presents
points of interests and importance
outside of ite bearing upon the local
difference under consideration. It
involves a question of right, which.
should be considered upon higher
ground than mere special interest or’
present bearing. If it be established
that the farmer can compel the miner to sispend operations, when
those interests are conflicting, upon
the same basis of justice some fuature interest may demand that the
farmer shal) give ap his vested
rights,.and abandon the results of all
his many years labor, antil there is
no security, and the progress of civilization is turned backward into the
desolation of barbarism. More than
this, if it be clearly established that
thie right prevails in California, it
will be claimed in every other part
of the country, whenever self-interest and might may demand. It
would seem, in the present case, as
ifthe miners had many points in
their favor, as they were first in possession, and all agricultural improvements were located and perfected
with full knowledge of the operations . .
