That the continued operatien of
the hydraulic mines will necesea
rily destroy the rivers, is « far-fetched conclusion. The opinion of the
best civil engineers in the land is
i effect that properly constructdebris dams will afford ample
and permanent protection: to the valleys, Judge Temple showed by his
decision that he had faith in this
theory (no man with good judgment
and without prejudices of » sectional nature could do otherwise) and we
are firm in the belief thatJudge Sawyer, who is one of the ablest jurists
werhave, will in the main coincide
with Temple's views. The miners
are entitled to the same degree. of
_ Governmental protection that the
Appeal says the farmers are, and it
is abeurd for the more rabid of the
anti-miners to nuree the selfish hope
that Congress will countenance the}
suppression of hydraulic mining.
Even the Appeal as much as admits that the miners are not without
justification in their claims vf possessing strong equitable and vested
rights, when it expresses as willing:
ness that Congress remunerate them
if they are deprived of the use of
their property. If they ‘had uo such
rights, they would certainly not be
eutitled to recompense at being deprived thereof; and in the possession
of said rights they have something
that was given them by the National
Government, for a consideration,and
@ county or State cannot through its
judiciary rob them of what they acquired lawfully from the higher power.. But has the Appeal ever stopped to think what eum of money
would constitute an adequate remuneration to the miners for the taking . .

cut off one of the chief sources of
the country’s metallic wealth? An
industry that annually pours twelve
or Gfteen million gold dollars into
the lap of America cannot be bought
with the price of a -few hundred
_ acres of tule land along the miasmatic banke of the Sacramento river.

have too much cunfidence in Saw:

say again, as we said long ago:
“Their (the: miner’s) cause is 80
just, their rights so patent, both
equitable and veated, that there

prove to be the case, through bias,
prejudice, personal interests, or lack
of judgment, they have the United
