The following remarks from the
Sacramento Record-Union will apply with equal force to the state of af
fair#tin Nevada City: The question
has often been asked why a chain.
gang was not in operation here in order to make vagrants, petit lareeny
“thieves, etc., doa little work occasionally. As we understand, the,
matter, the City Trusfees ‘have hel}.
when the subject was up for consideration, that the expen’é “would be
heavy, and that there were so many
good mon in search of work that if
the city had any to give it would be
better to hire them to have it performed by prisoners.;, The expense
referred to includes the pay of two
odicers to watch aud work the gang,
the feeding of the prisoners, the cost
of transportation in wagons to and
from the place where they might: be
at work, the tools and material to
work with, ete. Doubtless.in that
view of the case there would not be
any economy in havisig work performby prisoners; but if therewasa chain?
gang in which vagrants and thieves
would have to work there would
be fewer of them in the city, gaining
a living by begging and stealing, and
the city andcounty would have much
leas to pay for their-keeping in jail.
As things are go.ng now, the undesirable element increasing so rapidly
in town, it would be a very good
thing to have'a chain-gang organized again.

Important to Ditch Owners.
An important decision was recently rendered by the Unit-d States Supremeée Court, involving the question
as to whether a person whe has constructed a canal or ditch for the purpose of mining or irrigation upon
can be forced to abandon the same
hy another person claiming title to
the lands under a subsequent grant,
The convt hols that the rights of
owners of ditches or canals in such
cases are rights which the Government has recognized and is bound to
protect. The patty claiming the
jand, acquired it subject to the right
of way of the owners of the ditch or
canal, tacitly or formerly recognized
by the Government, and that right
cannot now be disturbed.

Elser’s Concert.
The musical entertainment given
Sunday evening on.Broad street by
Prof. #lser and sons was a most enjoyable alfair, The selections were
ehvice and well rendered. The overture from the ‘Bohemain-~ Girl,”
“Tales from the Vienna Woods” by
Strauss, a clarionet solo and dustt,
selections from "La fille de Madame
Angot,” and various other morceaus
were all received with great applause. Notwithstanding the inclemency of the weather that evening, lovers of music wefé well represented, It is the intention of
Prot, Elser to give a series, of these
antertamments and everybody is
cordially invited to attend, s
The Target Shoet.
The. special target shoot of Nevada
Light Guard: at.the.Rifle Grounds
last Saturday, was participated in by
43 members. The Haymond medal
was won by EF. A. Wetmore, making
a score of 21 points: The $20 medal made by C. J. Brand was won by
Q, C. Pervival, who made 21 points,
and the $10 medal .by O,.A. Nelson
in 20-points:—B-B—Fhomas scored
20, and. took! the $3 50 pony purse,
while D, B. Getchell got the”
purse in 19 points. The general
shooting of the-Company was better
thea ordinary, 22 bullseyes being
made. The boys had a fine lunch
spread, unler the’ management of
Alex. Gault.

Jas. H. Byrne, formerly of Moore’s
Flat, but for several months past a
resident of Nevada City, “
The statement of the affair made
by one uf the two young mén” who
hid been ‘‘making a night of it” in
company with White is in substance
as follows: Saturday evening Byrne
hal drawn his revolver on a wellknown young man of the city at a

Byrne receiving a severe cut on the
iorehead, It seems that he recovered
possession of the weapon during this
part of the fracas, for about the time
he was struck he raisedit and pulled
the trigger. White fell to the floor,
shot through the forehead over the
right eye. ‘The wounded man’s
friends went aftcr a physician at the
instance of Byrue who stayed in the
saloon and assisting him to a chair
bathed the wound and endeavored
to stop the flow of blood until Dr.
We.ch arrived and made an examination that showed the skull to be
fractured, but failed to discloss tha
locality of the bullet. White was
takeu to the City Hall and made as
comfortable as possib.e until about
Yo’clock when Dr. Hunt came and
ordered him removed tothe Hospital,
Byrne gave himself up to offi.er

have been interviewed, and with the
exception that they regard White
and his crowd as the aggressors in
the bar room, they agree as to the
correctness of the above account.

far as the present proprictors are concerned, They have always made it

It is possible that the injured man

Patterson ‘Ptacer Mine.
The Independewt says: The Patterson Placer Mining Coimpany comprising grounds located at Cherokee,
Badger Hill, and Chimney Hill, four
miles above, received a patent thereto a few days ago, This mine is
owned by Joseph ;Hustler, “J. Nankervis, M. Fitzpatrick, the Eureka
Lake: Co., the Milton Water €o.,
estate of J. B. Hunter, deceased,.
and about thirty other persons, The
claims include an average of over
300 acres comprising some of the
richest ground on the Ridge. Jas.
A, Stidger was the attorney for the
company in procuring the U. S.
patent.

Accident on the Koad. -_
During the storm Sundry night!
Mark Shaver and Adolph Chaty with
their wives were coming to this city
from North Bloomfield. ‘he darkness wasintense and just.as the flume
on the other side of Sugar Loaf was
being passed under the carriage in
which they rode tipped over, breaking the top from it and spilling them
out. They righted the dismantled
vehicle and three of them rode into
town while one of the gentlemen led
the horses to prevent further accident.

To Commence Crushing.
The new flume on the Pattison &
Derbec mine will be completed today, and it is the intention to start
the mill to-morrow for the first time.
There is over 100 tons of ore on the
dump, and more can be extracted as
fast as it is wanted. « Some good reports from this property may be expected before long, as the ledge is
uncommonly large and the test lote
of ore have yielded well,
Young Byrne Discharged.
J. A. Byrne, the young man who
was once tried on the charge of robbing the plates of the rittsburg mill
and convicted, had a new trial Saturday. The case was given to the jury
at 9:40 Pp. M., who within two hours
and a half returned a verdict of not
guilty. The attorneys for the defense were Messra, Kitts and ‘Taylor.

It is likely that Brown has also been

State Lottery Company have been
arrested, and the books, tickets and
other paraphernalia of the business

Shermerhorn estate over an inch of
ground at the rear of the. Schermerhorn property on Nassau street, and
at the end of a wing of the Equi'able
building, was continued before Judge
Van Brunt. The case had been’ at
issue since February, 1877. Within-a year Alfred’? W. Craven, the
well known ex-engineer of the Croton Aqueduct Department, died in
London, and Alfred Shemerhorn,
another defendant, also died, and
there remains of the oriyinal defendants only John Shermerhorn.
