Yesterday morning at 10 o’clock,
. . ‘was the time fixed by Judge, Reardan
for sentencing Benjamin Reed, who
was indicted for the murder of Chris.
tian Gunnison in this city, on the 2d
day of November last.’ The trial
was concluded last Tuesday. The

he got within four or five feet Reed
discharged his pistol, and in an hour
-his victim died. The case was con.
cluded on Tuesday by a verdict of .
manslaughter rendered by the jury,
and yesterday morning fixed for sen-.
tence. When asked by the Judge
whether he had anything to say why
sentence sbould not be passed by the
Court, Mr, Waters, counsel fcr the
defendant, said he had not. J udge
Reardan ordered the prisoner to stand
upand he did so. The J udge then
stated the facts’of the case as shown
by the evidence, and said in effect:
that had the jury brought i m a verdict-of murder in. the first degree he
should have thought it f ally sustained by the evidence, and that a verdict of murder in the second degree
would have been an evidence of leniency on the! part of the jury, but
since the verdict was for manslaughter,a lower offense;he felt it a duty to
give him the full extent of the law.
