Discharged From Custody,
In the case ofthe People vs. P.
Tierney, Judge Walling yesterday
made an order discharging the defendant from custody, the previous
conviction for rape having been reversed by the Supreme Court. He
had been in the county jail since:

Repairing Washington School
Building—Salaries Adjusted.
At yesterday’s meeting of the,
City Board, of Education, the
Chairman of the Committee on
Repairs reported that some of the
sills and the roof of Washington
school house needed repairing,
and that Geo. M. Hughes has
been employed to do the work.
The Finance Committee recomday, September 7th; that an assistant teacher be employed for
the High School; and’ that the
schedule of salaries for the ensuing year be as follows: Principal, $125; High School, $100; Assistant, $90; first grade grammar,
$90; second, $85; third, $70;
fourth, fifth, sixty and seventh,
$60; eighth, $75; Selby Flat, $40;
janitor, $50. Total, $1040. The
report was adopted.
The Committee on Supplies was
instructed to get additional seats
ior the bigh school.
Applications were received from
thirty persons: desiring positions
as teachers in the Nevada schools.
The Principal’s report was read
and fiied.

A Rare Bird.
William Horrell last Friday
killed at Kistle’s ranch on the
xed Dog road a blue heron measaring six feet from tip to tip. tt
is an excéedingly rare bird in this
aeighborhood, and will be mountad and put on exhibition at the
saloon of John Conn, the Farmer’s
son. A shorttime before Horrell
silled it, it was engaged in burrowing with. its long beak into a
grave in Pine Grove cemetery,
having dug a hole eighteen inches
deep when frightened away.

The family of our fellow-townsman, R. McMurray, will take
their departure for San Francisco ‘next week, where they will
take up their summer residence,
returning to San Juan again in
the fall. This change will be
made for the benefit of Mrs. McMurtay’s health.

Warren Green made our town
a visit on Sunday last and left on
Monday for Marysville via Camptonville. Mr. Green speaks of
making Nevada City his home in
the near future.
On Monday evening last as Miss
George Farley entered her bedroom to retire to healthful slumbers, she heard a noise on the
roof--of an apartment ad,oining
her bed-room, to which is a window looking out upon the roof.
Thinking tne noise came from
nocturnal visitors in the shape
of cats, she paid no attention to
it. As she was about undressing
she happened to glance through
the window, and discovered a
man on the roof-in his stocking
feet “and bareheaded. Her
screams frightened the man, who
climbed down an apple tree which
stands close to the cornér of the
building and made his escape.

For some weeks past there have
been several spies in this neighborhood, Sweetland and French
Jorrall. On Wednesday last at
3weetland one of these spies, by
the name of A, J. Blerin, of Sutter
county, who represents himself
as a U.S. detective, got ona high
aid drunk with boys at Sweetland, and ‘‘painted the town red.’’
When-Blerin—first-made—his—appearance here the people thought
he was a Sabbath School teachar, but when he got about 30
lrinks,of ‘‘red-eye’’’ into himself
he seemed to have forgotten his

Death of an Old Nevada Countyan.
Last Wednesday Albert N. NutPlacer county. He came around
the Horn in 1849, and resided
continuously in this State ever
since. On landing here he went
to Coloma and ¢ommenced ‘mining, and followed. that industry
without interruption until the
last few years. . About, 1854 he
moved into Nevada county and
became actively identified with
mining entérprises at Liberty
Hill, Lowell Hill, Diamond
Creek and other neighboring localities. He was an expert prosnumber of good mines, some of
which are running and paying today. In 1879 he and his partner,
A! Cooper, sold their claims and
purchased a foothill farm near
Clipper Gap. There he has lived
since, honored and respected by
all who knew him. As _indicating the character and integrity of
the man, as well as that-of his
surviving partner, Mr. Cooper, it
is only necessary to say that they
have been associated together in
business for 25 years, and in all
that time there never was a
scratch of a pen between them
nor a misunderstanding. “Mr.
Nutting was a single man without
. lood relatives in this State, and
tis near relations being dead,
‘he deeded all his property to Mr.
Cooper and his family.
That Powder House.
Edwin Tilley, local agent for
the Safety Nitro Powder Company, called at this office yesterday
to make a statement about the
building of the magazine at the
junction of the old Washington
road and Nevada street as mentioned in this paper yesterday.
He says that the Company began
.the.construction of the building
without having the faintest suspicion that the. residents of that
neighborhood would raise any objections to its being put there, and
that the Company desires to
avoid having any trouble about it.
He claims that this powder is the
safest of all high explosives yet invented, and thinks that when the
objectors come to understand’
this, as well as that the building
is to be used only as a temporary
storage place to put the powder
in for a few hours at a time while
it is being transported from the
manufactory to the mines ordering it, there will<be no further
objection to it. On the other
hand, the people out that way
say they have fully looked into
the matter, and having become
satisfied that even the temporary
placing of the powder there would
put buildings and people in that
locality in jeopardy, they are firmly determined to prevent the
company from carrying out its
plans.
