Important Decision as to Mineral
Land Patents,
‘The Washington correspondent of
the Sacramento Record says: ‘‘Under
__the Act of May 10, 1872, the survey
of mineral lands sought to be
‘patented must be made by or ynder
the. direction_of the Surveyor-General before the application is filed.

after “the expiration of the~ ninety
days’ publication. Again, “under the};

while the patent under the old Jaw
‘conveyed but one vein or lode;-the.
new law enlarges the rights of
patentees by giving them the right to
all. lodes, ledges and’ veins, the top
or apex—of which lie within the
exterior boundaries of the survey,
~and which were not adversely claimed
on May 10, 1872
might be filed-at any e pep yin
to the expiration fthe 90 days’ publication, white under the new law
laims must be filed, within
sixty days’ publication, and suit
commenced within thirty days from
“the date of such filing, For these
reasons the’ Commissioner of the
Land Office holds thatapplications
formineral patents filed under the
old law after its repeal; must be recommenced under the new law. As
there are quite a number of such
useless applications. from the Pacific
coast, there will.be a proportionate
. amount of loss.in time and-money,
or otherwise.—For this-the Commris-+
‘sioner cannot justly be blamed. It
is the fault of those lawyers who
advised their clients wrongly, and
proceeded under the old law right
a“
Nor can thesé~Jearned gentlemen
honestly plead ignorance in the face
of the fact that the passage of the
new bill. was notorious—was_telebill itselé spread before t They
must-have known these di ences
between the old and new laws—diffor the Commissioner to proceed in
such casés—and knowing them, what
ean be thought of the lawyer who,
ignoring the new, proceeds for his
client under the old laws?”
Tur Late Homicrpe at BeLMont,
Nev.—We mentioned afew days ago,
says the Grass Valley Union, that
Con. Murphy had been stabbed’ and,
_ killed by James Mullen; that both
were formerly residents of Grass Val_ ley, and that Mullen has a wife and
children now residing near town. A
correspondent of the Reese River
Reveille of January 11th, writing from
Belmont, Nev., givea_the following
particulars: Ou Sunday~last,’ near
East Belmont, Con. Murphy~ “was
stabbed -by Jim Mullen. Murphy)
died in-a few hours afterwards.
~ evidence before the committing magthat Murphy had been dogging Mullen for along time, and at different periods had threatencd violence, so
inuch so that Mullen was afraid of
his life. The men met on Sunday
with the result above stated, Mullen
immediately gave himself up to the
Sheriff. The decision of the Justice
was justifiable homicide. The pris“boner was at once discharged. ~
