The men engaged in one of the drives unexpectedly broke into the old workings. of No. 1 shaft, and immediately au immense . body of water broke .the mine, and rising in a very short space of time to a height of thirty feet in the shaft. Article 22, séction 10, provides how_ ever that ‘judicial officers and the Superintenden€ of Public Instruction shall be elected at the time and in the manner that State officers are elected.” The Supreme Court having decided that Justices of the Peace are. ‘‘judicial officers,” they must be included ; and article 9, section 2, of the Constitution provides that a Superintendent of Public Instruction stiall ‘be elected: at each gubernatorial electi As the Conislly fixes the . Peace, and does not give the Legislature that power, the election must take place each four years; and the ter the next gubernatorial election. The action of the Legislature, therefore, in fixing the length of time the Justices shall hold office'is void beeause the Constitution in no place gives them power in the matter. The Tehachepi ‘Horror. The railroad officials state that “the accident near Tehachepi. station was not dae to any caréléssness on the partof any of their employes, but was simply the result of another attempt to rob @n_express car. They state that they have ~no doubt that the brakes. were properly set and thatthe train was. tampered<with. It is known that when the train drew into the station two men were “sgeen there who were subsequently found dead in the wreck, and who are as yet unidentified. These men, it is thought, were part of a gang “that attempted to rob the train, and in order to effect their object let off the brakes'and started it down the grate i in order to get it away from thie “ex press-car-could be robbed, — Being unexperienced, they lost control of the train, and the accident occurred. In‘view of the accident, and the different reports concerning the nuinber-of persons killed while riding on _the-roads managed by the Central Pacific Company, Superintendent Filmore has had prepared from the books of the Company the following statement : “During the seven years ending December 31, 1882, there were 48,163,245 persons carried over the Central Pacific Railroad and leased lines, of which number 27 were killed through their own carelessness or misconduct, and in no instance was it any fault or blame on the part of the Company,” The leased lines include the Southern Pacific, and all lines except Was to Monterey. TWELVE Victims ot the Southern Pacific disaster have been identified at Los Angeles, but two bodies still remain unknowa, Seven boxes were found to contain the remains of dressed beef instead of human beings. Most of the injured are doing well, but ex-Governor Downey and ‘Colonel Waterhouse are suffering severely.’ The Coroner in charge of the inquest at Tehachapi believed . . the loss of life to be greater than re. A.Reno Guzette reporter et Guy Thorpe Tuesday at Carson and got some items in regard to the scene of the robbery and iourder at Silver Peak whick are interesting. He says it was John Chadovich’s store which was robbed at Silver Peak, and he thinks at Lida Valley instead of Gold Mountain, as he. had no store at Gold Mountain. He has private information that the robbers} “were driven away from Silver” Peak . without getting into the store or killing anyone. Some fndians were started to track them, but they kill: ed the Indians. It is reported that’ pat Lida Valley or Gold Mountain,, whichever it was, the storekeeper, In connection with the above, his clerk and two robbers were. killed.He heard by private dispatches that as soon ‘as the’ robbers -came everybody took to the brush and the-robbers took what theywanted and left. are_a band of lawless men that gathered together out in Lincoln and: Nye eounties and robbed stores, stole horses and lived by plundering. small towns, The country all south aud east of Hawthorne is full-of lawless men who live with squaws and are ready for anything desperate.
