A Judge's Courtship. 3 “Speaking about courtships,” said attorney Grove L. Johnson during a recess of the Superidr Court Tuesday toa number of gentlemen with whom he was swapping yarns in the Sheriff's office, ‘‘the shortest one I ever heard of was that ofan eminent jurist. He was on his way to hold courtin atown when he met a young woman returning from market. ‘* “How deep is the creek, and what did yon get for your butter?’ asked the judge. : _ ***Up te the knee and ninepence,’ -was the answer, as the girl walked on. The judge pondered over the sensible brevity of the reply, turned his horse, “rode back and overtook her. ***T liked your answer just now,’ 'would make a good wife. marry me?’ Will you A FATAL FIRE. An Awful Accident at the Idaho Mine. (Grass Valley Union, Tuesday Morning.} Much excitement was created in town last evening about 6 o'clock upon the announcement that the {daho shaft was on fire at the 1600 footlevel. It was subsequently learned that all the mén were out of the mine, as the fire started about the time the shifts were changing. The fire was first discovered by Steve Uren and James Bastian, but they could not ell to what extent the tire had spread, udthough it was believed there was considerable. The lower levels were all filled with emoke at7 o'clock, P M. Immediately upon the news reaching town that the shaft of the mine wason fire Supt. Edward Coleman, who-had but a half hour before come infrom the. mine, went out.in company with Foreman John Carter to take measures for the suppression 0: the fire. Upon arriving at the mine Mr. Coleman immediately organized a party of miners, and with them descended the shaft on the cage. Later it was as¢ertainedthat there were several men still in the shaft at about the 9:h level, and another party volunteered to go duowm and bring them up; this. party consisted of Jas. Bastian, J. Roberts, V. Granholm. H. Havel who returned with Crase. Then another party descended consisting of J. Goldsworthy, H. Hansen, J. Batten, J. Uren, and V. Granhalt. They brought up four men, whose names, inthe excitenient could not be learned. Immediately another party of rescuers, H. Hansen, 8S. Ralph and E. Hooper, went down but were forced back without getting any-ene else owing tothe smoke and foul air. “The next party who went down, John ‘Ralph, Passiher, and T. Dunston, were compelled to returm without tinding méans of descending lower than the ninth level. Poor Frank Carter, Jr., was brought up dead He started below and in trying to stop the flames became too faint to stand and after being placed on the cage, be fainted and fell, his head hanging over the edye and at the 8th level the upper portion of his head was caught between the -cage and timbers and crusaed out of shape, killing him instantly. Fully a dozen men were brought up-uncenscious—and—only—restored by continued efforts. E. Coleman was unconscious for fully half an hour but through efforts of fffénds and doctors was finally resuscitated sufficiently to be taken to his home. The labor of getting out the sufferers was greatly retarded by the crowd ol “She looked bim over and said: *Yé6s.’ ** *vhen get up benind me and we will ride to town and be married.’ “She did get up behind and they rode to the court-house and were made one, It is recorded that the marriage was a preeminently happy one:’’ Union Sunday School Picnic. Rev. William Angwin and Henry Weisenburger representing the Methodist denomination, Rev. Robt. Lennie representing the Baptist, D. E. Morgan representing the Episcopal, and Mrs. C. C. Smith, Mrs. Beightol and Miss Eliza Thomas representing the Congregational, held a meeting Monday afternoon and arranged for a union picnic at Chicago Park on Wednesday, the 26th instant. The public schools will close on the 21st instant, therefor all children who desire to attend the picnic can do so. Of the scholars in the Sunday schools connect ed with the churches mentioned, girlsunder-18 years of age and boys under 16 will be transported free. For older persons or those not scholars in any of the Sunday schools, the rates will be: men, $1; ladies, 50 cents.Advertisements of the event will appear soon. The New Discovery. A number were sent down at 8:30 o’clock to look for Jack Ralph, (a cousin of the deceased Frank Carter) and Thomas Dunstone who up to 9:30 o’clock were> sfill missing, and it is feared they are dead at the 19th level, as it is jinpossible upto going to presfor any one to go below the 9th level. The last two parties who went down up to 9:45 for the purpose of opening the air pipe at the 9th level were, Hooper, Thomas, Keith, Durbin, ‘Fo Andrews, R. Jones, Jr., and H. Eva, _and the evidence is suffici nt to supTHE SUPREME COURT. Rulings in Cases Appealed From Nevada County. ~— The Supreme Court has made the following rulings in cases sent up from the Nevada county Superior Court. McShane vs. Carter—The submission in this case is set aside and cause is ordered to be orally argued. Taylor, appellant, vs: North Star Gold Mining Co., respendent.’ This Was an action to set aside an assessment sale of mining stock. It is admitted that the assessment proceedings were regular. The material fact: upon which the objections to the sale are based are as follows: The. defendant was a corporation organized for the purpose of. mining for the precious metals. Success did not attend its operation and business was discontinued. The organization, however, was preserved. The Secretary was continued at a small Salary ; and the taxes had to be piid upon the property. In this condition of affair: one of the largest stockhol !ers organized a scheme by whicly it was hoped to give value to the property. In sabstance it’ was this: The corporation acquired the works of an adjoining miue called the Scotia, which also had thesé works and own its mine to a new corporation called the North Star Mining Company, which raised money fo: renewed work upon said mine. The consideration which the defendant received for the transfer of its property consisted of stock in the new corpoartion. Ia the course of the transaction the defendant incurred indebtedness as follows: For services of in attorney-a‘-law, $800; and for incidential expenses in and about the transaction, such as the employment of an expert, a broker, traveling expense: and the like, $2,009. These sums, tozether with tirat due to the Secretary and for.taxes on the mine, amountea to $3,940. Some question is attempted to be raised as to whether the defendant authorized the incurring of a purt of these expenses. But the services and expenditures were incurred on behalf of the corporation and with its knowledge, and it raised no questiotas to their having been author ized, but borrowed money from one of its stoekholders to pay what was due iorthem. It was to pay the money x0 borrowed that the assessment wa: levied. The—plaintiff—knew—ot—the Whole transaction while it was goin, on, and made no objection thereto. (Tr. fol. 156 and 286-87.) The under taking: was a success, and the property became very valuable. ~ The pliintiff does not seek to have anything set aside except the assessment sale. Coleman has sufficiently recovered to return to the mine.
