Dibble, defending, The deed was committed at a small cabin ocenpied by Hays,:-who was watchman of the wood belonging to the railroad Company, which was located near the railroad a short distance from town. The deed was committed between 4 and 6-o’clock-in the afternoon, and the evidence-is entirely ciecumstantial. On the ‘same evening Hays drew Sowe money he had in town, and left for Cisco, where he was afterward arrested. -‘The body was found in the cabin where it was dragged from the outside nearths‘door. The defense is that the shot. was; fired when the party .') was attempting to enter the house with * intent to rob. “The defendant being a watchman was accustomed to sleep in _ the day, and claims to have been wakened from his sleep by the man at the door, Must pe OsEYED.—Judge Reardan, in commencing his duties, is pursuing a course €alculated to satisfy the public that the processes of the Courts must + be obeyed. He recently fined a default: ing juror $25, and yesterday fined a de faulting, witness $50. The witness made affidavit that he had not the funds necessary to pay his expenses.— The Judge stated that-by his’ absence the Court, attorneys and witnesses had been. kept waiting three days at an exnse, and that. while it might be a : hardship to attend, the failure to comply, with the process of the Court could not be excused. The witness should} = come, and after it were shown thet he was in indigent circumstances an a)lowance might be made. Tae Ratiroap Survey.—On Wednesday last Mr. Binney of the California Northern road, with competent éngineers, instruments, etc., commenced the survey for a line of railroad from Marysvillé to Nevada. The Grass Valley reporters imagined that the design was to fence that town in by fortifications, bat afterwards discovered that. it was Mr. B practical the only difficulty being between Penn Valley and=Grass Valley, whete the . . ascent is very. great.’ The Squirrel Creek route is. to.be surveyed to-day, and we have no doubt but that it will ‘show.a grade. which-can be made avail . -—~— able, } TE ee e RossERyY.—A roll of blankets, and & lotof wearing apparel, was abstracted from the milk cart of Mr. Sutton, at his ranch, on Wednesday night. The articles were placed in the cart over night for the purpose of bringing them _ to Nevada early next morning, but during the night some sneak ‘thief apped them, They belonged to a renchman ‘at work on Hitchcock’s ranch RaIsIns AND CIDER.—We are indebted to Wardsworth and Butterfield, ot Chapman’s ranch for a box of excel lent raisins, made from grapes raised by them, and also a keg of exceedingly palateable sweet cider—fresh from the press, VEGETABLES, ETC.—Messrs. Baltz & Gunther have established a new stand adjoining McRoberts & Vo. on Commercial street, where they receive every day fresh vegetables of all kinds, . also fish, eggs, butter, fowls and fruit. Their stand will be found well supplied with the best the market affords, at all times.
