In the case of the people va. Lord
the direct examination of James M.
Wiley of the Boston Ravine election
board was concluded Thursday evening at the hour of adjournment, and
on the opening of court Friday imorning cro8s-examination was begun. by
Mr. Johnson for defense. Wiley said
in substance: There was a change of
clerks of the board during election
day, Thos. Kelleher taking John Mulroy’s place. Mulroy again tuok his
place when the counting was resumed
The ballots were compared with the
tally list and counted three times before they agreed. I am a-Republican.
To the question, “Did you support Mr
Lord at the election,” witness said;
“As an Ainerican citizen I refuse to
answer the question unless I am
compelled to.’”’. Mr. Johnson said the
object of the question was to show
that all the members of the board but
"Wiley were Democrats. That Wiley
was uppointed to look out for the Republican candidates’ interests, — but
that he too was opposed.to and voted
against Lord. Witness said he could

City case of L. W. Dreyfuss and wife
vs. Mrs, Warah Giles: nt
Thisis an action to foreclose a mortgage. Thecomplaint alleges the death
of the mortgagor, the settlement of the
estate;the distribution of the mortgaged property to his daughter, an only heir, and the sale of the mortgaged
property by her to the defendants in
this action. It is also averred in the
complaint that the mortgage was not
due at the time the estate was closed,
and final distribution made, and was
not presented as a cluim against the estate. The complaint expressly waiver
all claims-against any other property
of the estate except the lands described
in the mortgage.
defendants plead the settlement and
‘final distribution of the’estaté-as a bar
to the plaintiff’s right to recover, and
this is the only question made on this
appeal,—_—
It was not necessary forthe plaintiffs
to present their mortgage as a claim
against the estate, and their failure to
do so, and the settlement and distribution of the estate;was no-bar to their
right to foreclose the mortgage. (Code
