THE DIVERS. Exploring: “the Undergeund epths of the Idaho. {Tidings of Friday evening. . ‘On¢this morning's four o’clock train arrived Water Page and William Tacker, two men who follow the vocation of .submarine divers. They brought along diving suits and the auxiliary apparatus complete. Shortly after eight o’clock they went to the Idaho mine and gave directions relating to signal lines, air-hose and electric wire, the latter being attached tu the wires of the Grass Valley Electric Light Co. at the mine and carried down the shiaft. They next carefully cleaneda'tripleaction portable air-pump encasedin' a box 30x20 inches. The divers’ suits consist of helmets of composition metal, weighing thirty pounds each. These helmets have an air-hose attachment and anexhaust in which » there is a valve to keép out the water. Three glass eye-lights, 2x3 inches’ and protected*by light iron bars, are also -provided. The remainder of the suit is of rubber and canvas, in one piece, which is adjusted to the shoulder-piece of the helmet by screws. Shoes weighing twenty pounds each complete the outfit to be used in the ‘underground explorations. With hose and all each suit weighs 120 ponnds, or 80 pounds lighter than those worn under water, From the 700-level down extra pliable insulated wire was used to conver the electricify for the lights carried by. ‘The steam engines not having been used for many months, much difficulty Was experienced in operating them and several unsuccessful attempts to hoist were made. Finally, at noon,the obstacles were overcome and the air pumps, 1550 feet of air-hose and other apparatus were sent tothe 700-level. At 2:45 o’clock the bulkhead below the 800-level was removed and three lighted candles sent down in the cage tothe 1000-level. One was brought back still burning, indicating less gas in the shaft than supposed. ANOTHER JUROR’S KICK. —— The Court Refuses to Entertain it. . THE FIFTA DAY'S PROOBEDINGS. A Great Many Witmesses Examined. i & When the Lord case came on in the Superior Court Saturday for the fifth day of the second trial, there were but twenty persons present outside of the jury, court officers and ‘“‘press gung.”’ Juror Ashburn was enjoying moderately good health. i : Juror Angove arose and expounded his religious doctrines. He ia a Seventh Day Adventist. Hesait that Saturday, being—the seventh day,—is his Sabbath, and that ‘or eight years he has to bis financial loss and generxl inconvenience observed S.tofday bp keeping it holy. No prdéspect of financial gain, fear of punishment~ of anything else could prevail. upon him to voluntarily b-eak the rule. His honor replied that he did not desire to question the juror’s sincerity or right to believe as he does; but that he thonght under the ¢tatute the excuse is nota legul one. Only leyal excuses could be accepted, He did not think the juror would be mora'ls or otherwise respdnsible fcr the’ performance of his duty on: Saturday se long as he did it under the direction of the Court. The reque-t was denied. Mr. Angove replied to the Judve by quoting scripture to sustain his position dnd expres-ed his regret at the situation. He contended his right to worship God as he saw fit, and said he should respectfully .and positively-decline to serve during the day. The Judge said he could not permit such a determination to be carriéd out by the juror, and could not understand how he could set himself up in opposition to the only rightful authority in this matter. Angove said his point was that he wanted to obey God’s Jaws as he understood them. His honor said if the juror persisted he should be noder the. painfal_necessity of enforcing the penal:y. The electric wire had burned, and an . hour’s timne elapsed before it could be . repaired.. . __At6 Pp. m. Page and Shoem:ker were at the 900 level, slowly descending to} the 1000 level. They had to return béfore getting dowu. The «istuber were too short. THE LATEST. : Nothing besides the foregoing was done Friday. 2 S At 10:40 Saturday morning Page and Shoemaker in their armor were luwered towards the 1000 level. Just*below the 900 level they found “the air so hot they had to return to the surface. They say they will not again descend at prerent. The fire is evidently raging again, asa result of removlosing the bulkhead below the 800 level. There is no telling when the bodies” will be recovered. The damaye to the mine is doubtless very great. Did Not Note the Proceedings. After “Judge Walling on Saturday morning refused to adjourn court. for the day outof reepectto the teual re» ligious observance of Juror Angove, the Seventh Day Adventist, Mr. "Angove appeared utterly oblivious to the proceedings. He looked down at the floor, never letting his eyes rest upon the attorneys or witnesses, excepting occasionally when the-attorneys got into a wrangle with each other. Then the prevailing excitement would cause him to look up, but in an iustant his eyelids would drop again. Cheap Bibbons. [At this stage u messenger arrived from General ‘Kittrell’s hotel bringing a linen coat for that gentleman. The.General donned it and his ‘‘biled shirt’? and snowy vest were once mere hid from the vulgar gaze of the public.] Cross-examined: Witness recited that he voted a Cemocratic ticket, and said if Ford’s ticket had more than one name scratched he did not do it. NICHOLAS SMITH, who also served as a clerk of the Boston Ravine Board: . His -testimony was substantially thesame as on the first trial. The principal fact evolved by the learned and astute attorneys was that Mr. Smith hadacod and could not speak loud enough to be heard more than four feet from where he sat. JAMES BAYS, another member of the election board, testified as to. the correctness of the count, his statements according with these made by him in the first trial. The next witness was PAUL MORATEUR. Nothing new was elicited from him. He maintained, as in the recount proceedings and at the first trial, that the board of election performed its duties correctly and according to law. He was still on the stand when court adjourned for the noon revess. AFTEENOON 8ES3ION. Tie crogs-examination of Mr. Morateur was carried on at length. His mnemory as to how he ‘had testifi d at the recount and firet trial was shown to be defective on several points. a WM. His testimony in regard to what he saw around, the Courthouse on the 19h and 20th of November was the same that he gave at the firstirial. Witness wag shown hallote from Boston Ka\ vine and asked if the name Geo. ] ord or George Lord thereon are in Mr. Lord’s handwriting. He said he was as to his belief. Defense objected. qiTo Mr. Johnson, witness sail he was not an expert in writing, and had signature.} Objection overruled. Witders signed with Mr. Lord’s name as it was written on three tickets. The answer was stricken out. “I would not say it is Mr. Lord’s writing. 1 should jadyge it is.” Cross-examined: Witness suid he could not select from a paper containihy Lerd’s name written 31 times, part written by Lord and part by some one else, the genyine signatures.
