a SATURDAY, JULY 22. ‘THE RIGHT OF PRIORITY. Phe’ Gonilick now raging between nineteén-twentieths of the miners andafew farmers of this State is gradually being brought to the notice of the Eastern press, and in due time the respective rights of the contestants go before Congress. for arbitration if the contestants do not arrive at an amicable understanding among themeelves. The Chicago Review has been looking into son:e of the decisions on the subject * emanating from valley courts here “since the trouble began, and that clear-headed and unbiased authority is constrained to find that in arriving at those judicial rulings” “the fact was not taken into consideration sufficiently, that the miners were first on the ground, ‘and received the patents from the State or Government, to conduct the business of mining, paying all the taxes and complying with every requirement. It was well known to those granting the privilege and to those who took up farming lands, that tailings were a necessary adjunct of placer mining. The farmers were fully aware ofall the evils of which they now complain, and came to live upon the very industry which they are now endeavoring to ruin. The right of way is one of considerabe importance, and it is said that a party cannot be denied access to public highways, even though he must cross others’ lands to doso, Others must suffer loss for his benefit or that he may vot suffer greater logs. Upon the same ground, it isa question of mach importance whether the miners can be compelled to suffer the loss of investment and the work of years when they have received from the Government land for a special purpose, well understood and defined. Such a grant for such special purmust carry with it certain rights and privileges. If others come later, they must accept existing conditions and not assume rights which have already been granted to first occupants. Priority carries with it certain privileges which must be recognized and respected.. California owes too much to the mining interest, to be unjust to the chief corner stone of her prosperity. Ee ele bm ome ms (WE THROW IT BACK aust A leading Sacramento. merchant who was inthis city assured us thaton account of the idiosyncrasies of the Bee, itwas not regarded as a reliable paperin its own town. It had uo influence, never had expressed the sentiments of the people that. it claimed to represent, and thé miners should> pay no attention to its wild assertions. He further eaid if ‘a vote were’ taken among the merchants uf Sacramento there would be scarcely one of the aumber who would endorse anything the Bee had said in relation to the miners.—Nevada TRANSCRIP’, _ Wethink now that our Nevada contemporary has made that out of whole oth, and that it had not a word of any leading Sacramento mer: ‘chant on which to base it. We set it down as a plump falsehood, —Sacramento Bee. We reiterate the statement contained in our first article, and hur! back the falsehood in the teeth of the Bee. Not only ‘‘one leading Sacramento merchant’’ informed us asto the status of the Bee in its own city, but three old representa* tatives of its leading houses have corroborated what we stated. On accountof its pusillanimous course towards the miners it has earned the contempt of all respectable people, andis only enilorsed by that class who seek to make coin and earn some iety in the unjust and wicked r against au industry that has made this State what it is to-day. The Bee itself is the author of the scurvy purpose of ‘‘engendering prejudice” against the mineré, originates and publishes it to keep up the ‘bad blood” on the part of the valley neople. Oh, shame on you, you miser-— able Bee. Tue Sec;etary of War has issued a circular calling for the dates of entrance, from what States, company, ete., of all-the War De;artment officers, and also inquiring as to the correct number of their relatives, residence, and if any relatives are in the Government service. The information should be' made public, not inan offensive way, but simply for the purposes of reference. The charge is repeatedly made by certain newspapers that army and navy appointments are largely controlled by a few old families who are slowly but surely leying the foundations for a monarchial form of government, In view of this charge and others of a similar character the action of the Secretary of War is timely and ap. propriate.
