°. Mining Law.
An application for a patent for lode
claim shoul not be rejected because
it conflcts with a patent placer
claim, in case the lode was known to
exist at the date of the application
‘for placer patent,
Where the owner of a known lode
fails to file his adverse claim during
the statutory period of publication
of the placer application, he is restricted by law to his lode, and
twenty-five feet of surface grouud ou
each side thereof,
In the State of Texas, all minerals
in the public school, University, asylam, and public lands of the State of
Texas are reserved from the operation of the laws for the sale of such
lands,
In Texas, any one taking up a
mining claim shall do at least $200
worth of work per annum on the
, Same, and furnish annual proof of
the same to the Land Board,
General averments of fraud and
wrongful use, without specification
or detail, do not present a case for
consideration,
The statutory direction that the
end line of a lode claim must be
parallel should be followed as a rule,
but under peculiar circumstances an
exception to the rule may be. allowed,
The taking of more width of surface ground for a mining claim than
is allowed by law does uotinvalidate
the location, and the mouument
stakes may be moved to cast off the
excess,
What is fundamental to the possession and right of possession of a
mining claim is remitted to the
courts, and parties who fail to set up
an adverse claim to an application
regularly made cannot protect their
righte by a protest submitted to the
Land Department,
One making application for patent
to mineral land, is required by law
to put on the premises notice thereof, The courts will presume such
notice given; which notice is of itaelf
& warning to all that the parties are
about applying for patent—seeking
to obtain title. If one party knows
the facts, or has opportunity to
kuow them, and chooses to take his
chances, the other party is fot estopped.
:
The Secretary of the Interior has
just decided that where two. applications are pending in part for the
same ground thé abandoument of
Oue gives life to the other, instead
ol jthe property reverting to the public domain, Also that a claimant
obtaining a judgment in his. favor
trom a competsut courtcan proceed
with his application for a patent,
notwithstanding an appeal, and ali
willbe valid if he be sucvessful in
appellate court.
Hereafter, no application for a
patent to mineral land will be recognized at the land offices, which includes more than one lode.
.
CoLonet SHaw, the United States
Consul at Manchester, England, has
received from President Arthur an
autograph letter, acknowledging the
receipt of a portrait of John Bright,
with the latter’s autograph, sent as a
souvenirof the recent Birmingham
celebration, In accepting the gift
the President states that in his esti
motion its value is greatly entranced
by “the kaowledge that the auto

the gift by Mr. Bright himself specjally fur me,” and adds: ‘I have
