fb FACT THAT A NEW COMPANY
__ has just been organized in this city for
the avowed purpose of making and vending
a Dynamite Powder called'sVulcan. Powder,
which Pewder. has been for over & year past,and is at this moment, underinjunction from
the U. 8. Circuit. Court at the East, and is
«oon to' be. proceeded ‘against on this coast,
renders it proper and necessary, that this
Company should make a statement concerning the present position of ita patent sitigation, to the end that no person should be induced, through the lack of information, to~
engage in & business which must shortly
bring him before the Courtsto answer to an
infringement suit. i.
The public is already aware ‘of a recént decision of the United States Suprame Court),
on appeal in the case of the Giant Powder . *
Company vs. the California Powder Works;and hag recently seen various newspaper ayticles in the interest of infringers upon the
Nobel Patents caleulated torereate a false impression as to that decision.
The decision inquestion.was simply against
the validity of two important Reigsues, Nos.
4318-19, both from gn old: Patent; No. 50,617,
4ssued in 1865, long prior to the Dynamite
invention, which latter invention was first
patented in the United ‘States by original
Patent No. 78,317, issued May 26, 1863, from
whigh Patent No. 5790 is a Reissue, andnot, .
na has been falsely stated, a Reissue of the
old Patent of 1865. .
This Dynamite Patent, No. .5799, conseaucutly has no connection whatever with the
oki Patent of 1865, nor with its ficissues,and
. = . g pvas notin any wise impaired by. the above
: caattaulfokerred to decision of the United* States Su“yreme Court. On the contrary, by that defision the case was sent back here for trial,
... aud the defendants were ordered to appear
and answer to the-suitoft this Company under said Reissue, No. 5799, which they must
do in due time. ‘
The Dynamite Patent (5799) is the vital
Patent of all the Nobel inventions. Itis the
Patent under which all the late injuuetions
have issued from the United States Circuit
Courts at the East. Under it two injunc
tions have already been issued thére,and are
to-day in force against the same Vulcan Powder, made by the same person, whe is to be
manager of the new Company here. In every case yet decided by the Courts this. Patent has been fully sustained. Under it the
