7 _QFFICE OF THE ~ PINT POWDER COMPANY, San Francisco, February 15, 1879. ‘TO-THE-MINING-PUBLIC. i ig = FACT THAT A NEW COMPANY j has just been erganiged in this city for the avowéd purpose of making-and-vending a Dynamite Powder called Vulcan’ Powder, which Powder has been:for over a year past, and is at this moment, under injunction from the U.S. Circuit Court at the East, and is soon to be proceeded against on this coast, renders it proper and necessary that this Company should make a statement concerning the present, position of its patent 1itigation, to the end that ne person should be induced, through the lack of information, to engage in a brisiness which’ must shortly bring him before the Courts to’ énswer to an infringement suit, ; cere “The public isalready aware of a recent decision of the United States Supreme Court on appeal in the ease of the Giant Powder ’ Company vs. the California Powder Works, and has recently seen ‘Various newspaper articles in the interest of infringers upon the Nobel Patents calculated to create a false impression as to that decision. : The decision in question was simply against the validity of two important Reissues, Nos. 4313-19, ‘both from an-old Patent, No. 50,617, issued in 1865, long prior to the Dynamite iaventlon, which latter invention .was first patented in the United States by original Patent No. 78,317, issued May 26, 1868, from which Patent No. 5799 is a Reissue, and not, as has been falsely “stated, a Reissue of the oid-Patontof 1965. This Dynamite Patent, No. ‘6799, consequently has no connection whatever with the old Patent of 1865, nor with its Reissues,and was not in any wise imp&ired by the above referred to decision of the United States Supreme Court.
