Cireuit Court at the East, and is sion tobe proceeded against on this coast, yonders it proper and necessary that this ~ Compiny should-make a statement. concern: . — ing the presentposition ofits patentsitigation, to the end that no person should be incuced, through the lack of information, to enzaze in @ business which must shortly bring him before the-Courts to answer to an. infringement suit. > 'Tite-pitblieis already aware of a recent decision ef the United: States Supreme Court on appeal inthe case of the Giant Powder Company vs. the California Powder Works, -and has recently seen various newspaper articles in the interest of infringers upon the Nobel Patents calculated to create a false impression as to that decision. : The decision in question was simply against the validity of two important Reissues, Nos. 4318-19, both from an old Patent, No. 50,617, issued in-1865, long prior to the Dynamite invention, which latter invention was first patented in the United States: by original Patent No. 78,317, issued May 26, 1868, from which Patent No. 5799 is a Reissue, and not, as has been falsely stated, a Reissue of the ott Patent-of 1865. haieee This Dynamite Patent, No. 5799, consequently has no connection whatever with the old Patent of 1865, nor with its Reissues,and was not in any wise impaired by the above re’erred to decision of the United States Supreme Court, On the contrary, by that decision the case was sent back here for trial, and the defendants were ordered to appear and answer to the suit of this Company under said Reissue, No. 5799, which they must do in due time. : The Dynamite Patent (5799) is the vital Patent of all the Nobel inventions, Itis the Patent under which all the late injunctions have issued from the United States Circuit Courts at the East. Under it two injunetions have already been issued there, and are to-day in force against the same Vulean Powder, made by the same person, who is, to be manager of the new Company here. In every case yet decided by the Court this Pa‘tent has been fully sustained. We commenced to receive applications for reregistration about the first of last June, and those who have not since been re-registered, either upon application or affidavit, may know that they, are not now on the new Great Register of Nevada County. The next election under the new Great Register will be held on the first Wednesday in Maf, 1879, for the ratification or rejection of the new Constitution now being proposed. A new printed Great Register will be required for said election. The use of certificates of registration has been abolished throughout the State.
