Yesterday morning Judge Reardan aecidedthé case of Cullovin vs. Morarity, involving the constitutionality of the law, passed by the Legislature concerning mining partnerships.” — The law provided that when owners of a mining claim desiréd to'develop eall a meeting, levy an .assessment and afterwards, if the asséssments were not paid, séll the interest of the delinquent according to the terms. of fhe law. In-this case, the plaintiff, Cullovin, was sold out,and he brought guit by bis attorney, W. W. Cross, for possession of the ground. The & Johnson; answered, setting up as a defence the assessment.and sale under the law above alluded to. Mr. Cross moved the Court to strike out fhis defence on the ground that it was unconstitutional. The regular-. and sale were not questioned, the motion resting entirely upon the question of the constitutionality of the law. The case was argued on Saturday, by Mr. Cross in favor of the motion and Mr. Williams in opposition. Yesterday morning Judge taining the position of Mr. Cross, He held the law to:be in contraven-. tion of that part of the Constitution, providing that ‘‘no person: shall be deprived of life, liberty or property without due process of law,” holding that the latter phrase meant a suit and judgment of a court of competent jurisdiction. As a number of gales have been made in this and other mining counties of the State, under the law, the decision has an important bearing upon the interests of parties. We have not learned whether this case will be taken to the Supreme Court cr not. Bold Attempt at Incendiarism. On Saturday night a bold attempt was-made to burn a barn, the property of E. D. Dean, on Coyote street, in this city. Mr. Dean was absent from home at the time. A quantity ef combustible matter consisting of pitch pine, old sacks saturated with kerosene, etc., was placed in one corner of the barn on the inside, and kerosene was thrown against the sides of the building. This done, ever did the work, had to pass elose to the dwelling, and between it and the barn: Fortunately the fire was discovered by the neighbors and they succeeded, after considerable work,. in putting it out. They first tried water, but it had little effect on. the flames. The progress of the fire could only be stopped by smothering. In a few minutes more the barn would have been in flames, and the dwelling and other property in the neighborhood would probably have been destroyed. Traeks were found near the barn, but ne elue to the perpetrator of the deed could be obtained. The Buchanan Mine. The Buchanan ‘mine is loeated in Willow Valley. It has been worked at intervals for several years and has always paid well when worked. The shaft is now down one hundred and fifty feet. ‘The ledge is twenty inches thick, well defined and the rock pays regularly from twenty-eight to thirty dollars per ton.With proper machinery for opening the Buchanan it would, judging from what it has shown under disadvantages of working without machinery, be one of the best mines of the locality. Hon. David Buel, of Nevada, one ‘of the largest operators in mines in Eastern Nevada, was in this city yesterday. quartz matters: in. The only medicinal agent by which this object can be fapidlyand safely accomplish: ed, isthe great vegetable renovant and invigorant, Hostetter’s Stomach Bitters. The operation of this célebrated specific is fourfold. It strengthens the digestive organs, regulates the secretions, improves the condition of the blood, superinduces a regular habit of" bedy, and thereby imparts such vigor and elacticity tothe whole physical structure as to render it capable of resisting the action of the poisonous’ miasma, with which the Spring atmosphere is always to some extent impregnated. Here, then, isa ready and certain means of escaping the disorders prevalent at this season, or (if they have already fastened upon the system) of conquering them speedily and thoroughly.
