Judge Temple Resigns:
Judge Jackson Temple of the Supreme Court has sent to the Governor
his resignation, to take effect on June
1st. He has while on the bench won
golden opinions for his uprightness
and ability, and the fact of bis having
resigned will be generally regretted.
Judge John Hunt of the Superior
Court of San Francisco is being much
talked of and strongly favored as Judge
Temple’s successor. Judge Hunt has
had ten year’s experience on the Superior bench. He is learned and incorruptible, and that he has the confidence of the people is evidenced by
his having received the largest vote
ever given to a candidate in his city.
He isin the prime of life, vigorous and
industrious, and able to render great
man can-do no better than to name
Judge Hunt as Judge Temple’s successor.
‘Will Open a Writing School.
Rogers & Williams, of Rochester,
New York, well known as the leading
American inventors of systems of
book-keeping, also proprietors of the
foremost commercial college in the
United States, are now preparing to
publish in connection with their own
system. of writing the system originated by Prof. .P. D. Horton of this
county. . Prof. Horton contemplates
shortly opening a writing school at
this city. He has the strongest of testimonials from the leading educators
of-the country. An opportunity to
study with so efficient-an instructor
may never again be enjoyed here.
A Pitiable Condition.
Old Mr. Reagan, the lone occupant
of the pioneer hotel building at Loyell
Hill which was burned on April 30th,
isin a bad way. He saved nothing
but the bed he had been sleeping on.
Hidden in a clock he had a five dollar
gold-piece and the same amount in
silver. The melted coin has since
been found in the ruins, excepting
about a third of the gold whichis missing. The old man’s loss was not
great, but it was his all, and the mishim crazy. Kind-hearted people in
the neighborhood have been providing
for his wants: since the fire.
A Collision and a Row.

ber, was on Sunday driving down
Sacramento street at this city, when
Arthur: Linden, from the same town,
and who was driving in the same direction, attempted to pass the firstnamed-rig when a collision occurred.
Johnson’s buggy was overturned, spilling him out and causing his horse to
run away. These things made him
mad and he turned toand gave Linden, who was drunk, a beating. Linden caused Jobnson’s arrest on a
charge of battery, and the case will
come up later in’ Justice Wadsworth’s
court. . .
Re-arranging @ Store.
Marked changes are being made in
the arrangement of the interior of Mrs.
Lester & Crawford’s -store on. Main
Street. The goods are being so displayed as to be most convenient for
patrons as well as for the store people, and the various departments are
set off by themselves in regular order
according to their relative importance.
This store compares favorably in extent and variety of the stock carried
with the better class of establishments
in large cities, and the prices charged
are as low as the lowest.

Change of Venue.

Appeal from an order refusing a
change of venue. The complaint avers
in substance that the plaintiff was unlawfully confined and restrained of his
liberty by the defendant at Nevada
township, Nevada county, California;
that a writ of habeas corpus was duly
issued to the defendant by the Supemanding him to produce the body of
the plaintiff at a specified time and
place ; that the writ. was served upon
defendant while he had the plaintiff
in custody and under his control, but
that defendant refused and still refuses
to_obey said writ; and that ‘‘by reason
of the aforesaid acts and doings of said
defendant, plaintiff has been unlawfully imprisoned and restrained of his
liberty by the defendant for the period
of five days, and has suffered damages
and injury in the sum of $5,000.”” The
prayer was for judgment for the sum
and costs. The motion was for change
of venue to Sutter county on the
ground that that was the residence of
the defendant. :
If the action is to be regarded as an
action of false imprisonment, the defendant was entitled to have the case
sent to Sutter county. If, however, it
is to be regarded'as an action for the
recovery of a statutory penalty under
Section 1,505 of the Penal Code,
which provides in relation to writs of
habeas corpus that: ‘If the officer or
person to whom such writ may be directed refuse obedience to the command thereof, he shall forfeit and pay
to the person aggrieved a sum not exaction in any court of competent jurisdiction’—then the retention of the
case_ in Nevada county was proper,
under Section 393 of the Code of Civil
Procedure, which provides that actions
‘for the recovery of a penalty or forfeiture imposed by statute’? must be
tried in the county where the causes
of action or some*part thereof arose,
subject to the power of the Court to
cases.
We think that the complaint states
a geod cause of action for fulse imprisonment,. The allegation that the
plaintiff was ‘“‘confined and restrained
of his liberty by the defendant,” is an
allegation of physical and bodily. restraint, which would serve as a founet armis. In such an action it is not
necessary to aver—as would be necessary in an action of malicious prosecution—that the imprisonment was
malicious or without probable cause.
(Colter vs. Lowell, 35 Ind., 286; Carey
vs. Sheets, 60 Ind., 20-1; Akin vs.
Newell, 32 Ark., 605.) It is not even
necessary to allege that the imprisonment was unlawful (though that is alleged here.) If matter of justification
exists it must be pleaded by the defendant. ‘‘Whoever assaults or imprisons another (except in some cases
under particular statutes * * * )
must justify himself by showing specially to the Court that the act was
lawful.”? (1 Chitty on Pl. 16, Am.
Ed., *p. 535; Galimore vs. Ammerman, 39 Ind., 318; Carey vs. Sheets,
supra ;: People: vs. MeGrew, 20 Pac.
Rep., 92.) Wedo not regard the expressions in the opinion in Hiresh vs.
Rand (39 Cal., 318) as intended to assert a different rule. The allegation
of imprisonment, coupled with the
averment of damage above quoted,
constitutes a cause of acticn for false
imprisonment.
And we are inclined to doubt whether the complaint can be regarded as
stating a cause of action for a penalty
under Section 1,505 of the Penal Code,
for the reason that the complaint
makes no reference to that section or
indicates in any way that it is for the
violation of a statute. But assuming
that it-can be so regarded, it is evident
that it was framed with a double aspect. In one aspect it is a good complaint for false imprisonment; in another aspect it may be assumed to be
a good complaint for. a penalty imposed by statute. Now we do not
think that the plaintiff by so framing
his complaint can deprive the defendant of his right to have.the case tried
in the county of his residence. The
rule is that ambiguities must: be resolved against the pleader; and we
think that this is a proper case for ite
application.
Even if the complaint be regarded
as stating two separate causes of action, upon one of which the defendant
would be entitled to a vhange of venue,
but not upon the other, the result
would be the same. It is the plaintiff’s own doing if the complaint be so
drawn. He cannot deprive the defendant of his right to a change of venue
by the addition of something to the
complaint. If this were not the rule,
it would be very easy for a plaintiff to
defeat the defendant’s right in the
matter.. All that plaintiff would have
to do would be to add another cause of

I dissent: The complaint either

all. There is no averment of any liability of the defendant under the original arrest. The averred liability is

Even the landlord’s claims for arrears

The courts have decided that as it is
an imperative right of humanity that
the dying should have the necessary
care and treatment,*such attendance
should be paid for before all the other
debts. Such a law in this country
would be hailed with satisfaction by
the doctors, and a similar prevision
for the undertakers would delight that
profession.

here Sunday morning for Dutch Flat,

just above You Bet, one of the horses
baulked in pulling out of the narrow
but swift flowing stream, and the carriage tipped over into the water,

Whisky Did It.
Ed Hutchings, the miner who was arrested last week for insanity, was released from the county jail Monday,
as he had entirely recovered his reason. His mental unbalancing was

A Chinese Disturber.
A drunken Chinaman—they are not
common—was brought tothe county
jail Monday to serve fifteen days for
having disturbed the peace. Justice
Paynter of Grass Valley was the committing magistrate.
