If upon -puveyed land, the entry shall in its exterior limit be made in conformity to the legal subdivisions of the public _ lands authorized by the Act of the re fourth of April, one thousand eight hundred ..d twenty: and where ~-the inhabitants are in number one hundred and less than two hundred, ‘shall embrace not exceeding® three hundred —» and twenty acres; and in cases where the inhabitants of such town are more than two hundred-and less than~one} thousand, shall embrace not exceelling six hundred and forty acres; and where the number of inhabitants is one thousand and over one thousand, shall em“brace not exceeding twelve hundred and eighty actes: Provided, That for each additional one thousand inhabitants, not exceeding five thousand in all, a farther grant of three hundred and twenty acres shall be allowed; And provided further, That in any Territory in which a land office may not have been established, declaratory statements as hereinbetore provided may be filed with the Surveyor General of the surveying district in which the lands are situate, who shall transmit said declaratory ~ statement to the general land office: And provided further, That any act of _ said trustees not made in conformity to * the rules and regulations hervin alluded the foregoing provisions according to such regulations as may be prescribed __ by the Secretory. of. the Interior: And “provided further, That the provisions of ~this Act shall not apply to-militaryor ~. other reservations heretofore made by __ the United States, nor to reservations _ for light houses, Custom Houses, Mints or such other public purposes as the Anteresis of the United States may re“quire whether held under reservations _ through the land office by title derived ~ ¢innabar or copper. You may, in my opinion, apply only for your own lands; that is, the lands on which the town of Grass Valley, as is now incorporated, is situated: provided, That you take it so as to ran by the nearest section, quarter section and 40 acre tract lines; or you might be entitled to claim # large tract surround+ing the town including Boston. Ravine and Hill’s Flat to the total amount of 2,500 acres of « basis of 5,000 popula~ tion, equal to four square miles. I ‘merely state this as the allowance of the law, for the people of Boston Ravine, Union Hill, Ophir Hill, Hill’s Flat, Horeka and.all other towns having a population of 100 inhabitants may claim their-own town tite of 320 acres.
