Sometimes’ I was inclined to suspect that the TRANscript wanted to have our Wortkingmen’s Board of Supervisors comm t themselves to a measure that woul justly be the political death of every mau who voted for it. That such a measure would be erroneous, unjust and ‘inhumag, I propose to show in this article. inhabited by men and wranenconvict-ed--of-misdemeanors.__-Mest-of-themare there because they are so unfortunate as to be too poor,te -paytheir fines. Lsay it is unjust, because we h-ve no right to harden petty. offenders by such outrageous ¢xposures, I say it is inhuman, because you have no right to brand one who has committed a mere misdemeanor with a brand that should be reserved for felons and cut throats. I say it is erroneous, because it is against law, being ‘ cruel and unusual ” puiiishment.” A mam is fined ten -dollars for being drunk, and being too. poor to pay it, must work in a chaingang on the pub i i¢ streets! You say Yuoa county does it, Many of the ranchers in Yuba coun, ty, however, are.old slave owners, ‘and “are bautish ~enowgh -for, anything. You say it willprevent crime. Why? How % Severity and exposure does not prevent crime, This 1s well established. You say it will save the taxpayers, but the taxpayers. have_net as yet grambled about it. But I deny that it can save the taxpayers one eent. Slave labor is always unprofitable. The extra cost of supervision, the chances of escape and the wear and tear of the prisoners elothing, by along way counterbalance any benefit that might accrue to the taxpayers. Relatively the plan is outrageous. The very felons-in-our State—Prison are not subject to any such ‘‘branding” as that of being compelled to work in chains on the streets of their own city, beneath the eyes of ‘their such case, would entail less real punishment than conviction of a petty ten dollar misdemeanor in Nevada county. The more barbarous the—age the more severe its criminal code. This is history. The more advanced a nation or State is, the more lenient is its penal laws, This will partly: be denied.) The more highly edacated and cultured the Judge, the more moderate will be. the penalties he metes out.
