MINERAL LANDS AGATIN.—It has

this coast to require proof of the mineral character of each forty acre tract

know the nature of land or who reside
upon claims unless holding some inter. est in them. Fortunately for the min+
ers the Commissioner has issued instructions to the Land Office at. Marys. Ville, under which these difficulties alluded to will beavoided, The Commissioner says: “You dre specially advised
not to suffer entries to be consummated
as “agricultural” entries, where there
is aprima facia showing, or wher
there is good reason to believe that the
predominating value of the land ap-.

gold; silver, ecupper, quicksilver, or
coal, without a full investigation
upon sufficient notice to parties ad~ versely interested, and furtlier instructions-from this office, after an examina-.
tion of the testimony thus taken, which
you are directed to transmit with your
joint opinion thereon.” We do. not
know that the Land Office at Sacramento has received the same instructions or not, but the rule is as applicable to mineral lands in one district as
in another. There is of course good
reason to believe that all lands located
within the rauge of the mining districts is more valuable for mining than
. for agricultural purposes. ‘This order .
Ofthe Commissioner is but /in aecordance with the old rule adopted in 1865,
by which it wags required that where
land was located within the mineral
range it was held to be mineral land . .
until the contrary was: proved, and vice
versa in the agricultural sections.. This
~ Yule would secure both miners and agriculturiste in their rights,

This has particular reference to lands
