the facts in the case. In vogard to the
~MecCharles road, the facts are about
these: A certificate’ of incorporation
was filed on the 2ist of June, 1861, organizing corporation to build a toll
road from Nevada by way of Grass Val‘ley to Rough and Ready. This Company only completed a road to the Town
Walk, and in 1863-4, after the citizens
~ gtibeeribed to. put. the road -in order
McCharles was ‘authorized ‘by the Supervisors to collect tolls. Afterwards
the road, it is. claimed, was transferred
“by McCharles to the Nevada and Grass
Valley toll road company, though no
record of the transfer éan be found.—
“The corporation was organized for
twenty years. pear
_ The Nevada and Grasse Valley toll
road: company was incorporated in
. , and “at that time a county road
was in existence. The county road was
also. open in 1864, a8 may be seen by a
petition ef the Nevada and Grass
Valley toll road company, signed by
Dr. Cleveland and now on file in the
County Clerk’s office. This petition
seta forth that the county road was unnecessary for the public use, an annoy-~
ance to the toll road company, and
aske that it be declared closed by the
Board of Supervisors. Tae toll road

expenditures of the road, to keep it
sprinkled and maintain it in good order.
The petition was rejected by the Board,
which was a virtual declaration that

Livety Times.—It appears . from
“Squires,” of the Times, that Pixley,
Cole and Sargent had a lively fight over
. he Pixley appointment. On the 17th
Pixley appeared before the Senate Ju-—
‘diciary Committee and demanded why
his confirmation was delayed,producing
his recommendation by numbers of
Californians. Sargent said “He was
informed that Pixley had been guilty
. Of professional . malfeasance.” Pixley
denied the assertion, and challenged in.
vestigation. Sargent replied that he
would furnish it, though he knew noth~
ing of his own personal knowledge
Pixley demanded a statement of a case
and Sargent replied ho would farnish
it. Cole here stopped the conversation
by starting a speech in which he spoke
highly of Pixley, and said he believed
the charge grow out of @ quarrel. between himself and Sargent, ‘and attempted to vindicate his own vourse,and
refiested on,Sargent,” ‘Sargent. arose
oot nyrriedly, his face as red as blodd, and
: ~said; ina very éxcited manner: “I came
here prepared to substantiate my manheod if nesessary. The remarks made
by Mr. Cole are false—falss, sir, and he
knew they were falso when he made

the other -papers in. the case, which
have this day been placed in hand for
examination and prompt adjudication.
‘When a decision is rendered in the
above case you shall be promptly advised, and a copy of the same will be
farnished you, which will be done in a
few days.

Hon. A. A. Sargent, House of Representatives—NSir: Referring to my letter
to you, of yesterday, I have now to state
that the claim of the City of Nevada
to certain land, in the Sacramento Land
District, under the Town Site Acts of
March 2, 1867, and June 8, 1868, has
this.day been approved, and the cash
entry, No. 146, covering the tracts in
question, has been passed for patenting.’
A copy of the decision in this case is
herewith enclosed.

Cal—Gentlemen: This office has exatnined the testimohy taken in support
of the claim of the City of Nevada to
certain land, under the Town Site Act
of March 2, 1867.
Our records show that the Trustees
of said city filed D.8. No.2, May 11,
1868, for the se 3 and 848 } sec. 12,
n ¢ ne } sec. 13, township 6 n, range 8
e, and s84nnw 4 and s w } sec, 7 and
n $n w 4 sec. 18, township 16, n,range
9 e, containing 644 68-100 acres. Also
that Joshua Malloy, John Cashin and
Daniel A. Rich filed for portions of said
Town Site ; but the testimony shows
that they have all abandoned their preemption clainis to the respective tracts
From ani exaniination of the evidence
in this case, it appears that the land
above described was selected in the year
1849 fora ‘Town Site, and from that
time to the present has been occupied
for purposes of trade.
At the date of the hearing held in
December last, the population of the
city was 3,000, and the value of the
improvements placed upon said land
was $700,000, consisting of churches,
banks, hotels, flouring mill, a court
house which cost $40,000, a school
house which cost $14,000,and numerous private dwellings: ©
erected gas and water works, and th
evidence shows that said City ot Nevada ig the business centre of a populous
locality.
The evidence also shows tliat valuable mines of gold existed at one time
upon said tracts, but that these mines
are now completely exhausted and
worked out, and the lands embraced in
the Town Site are now more valuable
for purposes of trade and as agricaltural
land. ae
These tracts at@ within the limits and
wete withdrawn for the use of the Cenc
tral Pacific and California and Oregon
Railroads, but having been occupied
for fourteen years as a Town-Site before
such withdrawal, said Railroads or the
State of California have no claim thereto
The corporate authorities, having
complied with all the requirements of
the ‘own Site Act of March 2, 1867,
and the amendatory Act of June 8, 1868,
the entry, cash No. 144, made at your
office February 5, 1869, by the Trustees
of the City of Nevada, and covering the
tracts herein described, bas this day

SILVER DamMMeER.—A silver hammer,
which is to,be used in driving the last
spike on the Pacific Railroad, says the
. Union of yesterday, came up from San
Francisco-last evening. In size -and
form it is the same as iron ones generally used, and its weight, including the
handle, is five and one-ha!f pounds. Asilver plate upon the handle is inscribed ‘
“For the last-spike ;~ fromthe Pacific
Union Express Company.” ‘This neat
piece of workmanship will be taken to
the “front”. by Henry C. Johnson, who
leaves the city this morning for that
purpose.
FALL River, MAss., with a population of about 25,000, has 19 cotton-mills,
with 507,000 spindles,manufactures 114,364,000 yards of cloth, or 64,997 miles a
year. This would encircle the earth
two and one-half times, “ The print

in the iron works is one million dolars, They use fifteen thousand tons of

the national Government, afford a good
éxhibit of their own superior economy
and honesty in government, in the municipal administration of New York.
The Comptrotlér of that city has just
sent in his estimate of the expenses for
the ensuing fiscal year. for legislative
millions for a single year. An associa—
tion of citizens, composed of the best
men of‘all parties, united for common
protection, have investigated all the
items, and show that, by a fair and just
estimate, $1,702,925 would cover the
whole cost—thus saving considerably

enough indicate what these‘sweet ducks’
