Smith and eleven other persons took a. con-. -—-—tract to work the Illinois and Wisconsin mine at Grass Valley, and they have ‘been 80 successful in taking out gold that they yesterday bought ‘threeeighths of the entire mine, During the last two months they took ont $11,000 in gold. This is the third. time Mr. Smith has been an owner in this claim, having made money in buying and selling each time prior to the last, and he is satisfied that he has got enough 7 sight to make money this time. By ~ the terms of the contract alluded to above, the parties were entitled to fourfifths of the proceeds of the mine,which they worked in ‘theirown way, using ‘the machinery of the company. He’ said “wherever devout and willing workers were found, whether among Catholics, Baptists, Congregationalists, Methodists or other denominations, they were God’s people if honest in their belief.” Such sentiments as these are worthy of Christians, and we love to hear them coming from the followers of Him who was.no respecter of persons. Williams & Johrison appeared for the defence and John Caldwell, District Attorney, for the State. Mr. Williams, on behalf -of defendant, made a motion to quash the indictment, on the ground that the testimony upon which it was procured from the Grand Jury was incompetent, being Chinese: The counsel stipulated that the question of the admissibility _ of this testimony should be tried without prejudice to the main question of the guilt or innocence of the defendant. This case’ is important as it involves the question of the applicability of the Civil Rights Law to this State. The < question will be argued in the County , Court, to-day. DEATH oF Major Ervinc.—On Friday last Major Elwyn Erving died at the residence of H. L. Hatch, Esq., at Indian Springs. Deceased was a young _ man of promise, who served with distinction in the Union army during the late war, in which, from exposure, he contracted the disease of which he died. His relations reside at Ploughkeepsie, New York, where he leaves an orphan child. SELBY Frat Scuoon.—The. Public School in Selby Flat District, will commence at the new school house on Monday next. The Trustees have employ¢d Miss Hitchcock to teach the school. THE FrreMen’s Dance.—On Thursday evening Pennsylvania _Engine Co. will give a benefit ball, at Temperance Hall. A splendid supper will be served ‘and excellent music has been engaged. . Delegations of firemen are expected , from San Juan and Grass Valley. Insane.—Ira A. Washburn was ex‘amined on Saturday last, on the charge ‘of insanity, and ordered to ‘be sent to Stockton. There are now about sixty
