ORDINANCE No, 4, The Board of Supervisors of the County of Nevada do ordain as fol: lows : : i SECTION I. Every person, firm, company, or corporation within the County of Nevada, now engaged in, or who may hereafter engage in conducting, transacting or carrying on any business in this ordinance hereafter named, must before, or at the time of engaging in the same, procure a license therefor, as provided for in this ordinance, ‘Rach person, firm, company or eorporation so engaged, or who may . hereafter éngage in such business must procure such license m the tax collector, and shall be liable to a license tax to be collected by the: said tax collector of Nevada County. Such license shall be paid for quarterly, (except as provided otherwise in this ordinance) in advance, and when issued, shall authorize the par ty named therein to transact such business in the said county, Separate licenses must be obtained’ for each branch establishment, or separate huuse of business located in said county. Three calendar months shall constitute a quarter, SECTION If. Auctioneers are divided into three classes and must obtain licenses from the tax collector as follows: 1— Those whose average monthly sales amouut to ten thousand dollars’ or more constitute the first class and must pay a license tax of sixty dollars per quarter, 2—Those whose averave monthly sales amount to twenty-five hundred. and less jthan_ ten thousand dollars constitute: the secvnd ¢lass, and must pay a license tax of twénty-tive dollars per quarter. -3--Those whose average monthly sales are Jess fhan twenty-five hundred dullars constitute the third class and must pay a license tax of seven dol lars and fifty cents per quarter, SECTION III. i Persons engaged in banking, loaning money at interest, or in buying or selling notes, bonds or other evilencesof indebtedness of private persons, or in buying or selling state, county or city stucks, or other evi-+ dences of state, county or city indebcedness, or stocks, or notes, vonds or other evidences of indebtr. edness of incorporated company; or in buying or selling gold dust,’ gold or silver bullion, yold or silver coin, are divided into three classes and must pay license tax as lollows : 1. ‘Those doing business in the aggregate tothe amonnt®-of thirty thousand dollars or more per quarte) constitute thé first class, “and must pay a licenée tax of fifteea dollars per quarter, > 2. Those doing business in any amount under thirty thousand dollars and over’ ten thotvand dollars per quarter constitute the second class and. must pay a license tax of seven dollars per quarter. 3. Those doing business in any amoont less than ten thousand dollars per quarter constitute the third class, and must pay a license tax of three dollars per quarter, SECTION IV, . Licenses must be obtained for the purposes hereinafter . named, for which the tax collector must require payment as follows: 1, Propriétors of billiard tables, not kept exclusively for family use, must pay for each table five dollars per quarter, . 2. Theatre and other places of amusement, must pay for each performance a license'tax of two dollars, 4. For each show for pay of any figures, jugglers, necromancers, magiciaus, wire Or’ rope dancers, o1 sleight of hand exhibition, five dol-. lars per day, 4, For each exhibition for pay, for a caravan or wenagerie, or any collection of animals, cncus, or other acrobatic performance, ten dollars per day. 5. Vor each pawn broker fifteen dollars per quarter, 6. For each toll road having a toll bridge thirty-six dollars per year, . Fhe provisions of this section do not apply to exhibitions or entertainments given forthe benetit of churchés, s¢hools, or other charitable entertainment, by any amateur dramatic association or literary society ot the town or district in which such exbibition or entertainment is given, SECTION V,’ 1. Every person who sells spirituous, malt or fermented liquors or wine in less quantities, than one quart, must obtain .a. license from the tax collector and must pay therefor a license tax of fifteen dollars per quarter, vs 2. Every person who sells malt or fermented liquors or wine in less quantities than one quart and who does not sell spirituous liquors, must . pay therefor a license tax of nine dollars per quarter, SECTION VI. Of all amounts over twelve hundred and fifty dollars’ and less than twenty-five hundred’ dollars per month, constitute the third clacg and must pay one dollar ‘and fifty cents per month. ‘ 4, Of all amounts’ less than twelve’ hundred and fifty dollars pee month, constitute the fourthclass and.must pay ones dollar per” month; Sreyniee that the sale of liquors and wines by persons licensed under section six of this ordinance must not. be in quantities of less than one quart measure; and further provided that no licence must be required of physivians, surgeons, apothecaries, or chemists for any wines, or Spirituous liquors they may use in the preparation of medicines, SECTIUN VIT. : Every traveling merchant, hawker or peddler who carries a pack and vends goods, wares, or merchandise ofany kind other than the mannufactures of this State must pay for a license five dollars per month; and every such traveling merchant, hawker er peddler who uses a wagon, or one or more animals, for the purpoge of vending such goods, wares or merchandise of any kind, must pay a heense of fifteen dollars per month, 5 SECTION Vil. _ Every person who keeps a stallion or jack and who permits the same to’ be used for the purpose of propagation for hire, must obtain a licénse therefor from the tax co!lector of this county and pay therefor as follows: * 1. Horses that are hired for the purpose of propagation, by the season, at fifty dollars or more, constitute the first claes, and must pay‘a_ license tax of forty dollars, 2. At thirty doilars and less than ifty dollars constitute the second class and pay twenty-five dollars. 3. At fifteen dollars and less than thirty dollars constitute the third class and must pay fiiteen ’ dollars, 4, All at less than fifteen do.lars coustitute fourth class and must pay ten dollars. ig 5. ‘For each jack ten dollars. SECTION. x, It is further ordained that. if any person or persons, whether principal or principals, agent or agents, clerk or clerks,emp. oyeor employes, or aby firm or any member of any firm or corporation shall he engaged in carrying on, pursuing, or transacting within the limits of the county of Nevada, any business, trade, occupation, Or employment, which’ is required to be licensed by the provisions of this ordinance without obtaming a license therefor as required by this ordinance, or shall, after demand refuse, neglect, omit, or fail to comply with any requirement or requirements, provision’ or provisions or orders of the said Board of Supervisors, requiring each person or persons, firm or corporation to procure a license, he, she, or they, or either of them, as the: case mity be, shall’be © deemed guilty ot a misdemeanor and on conviction thereof, shall be punished by a fine not “to exceéd one hundred, dollars, and’ in’. default “of ° the payment of such fine shall be imprisoned in the County Jail of Nevada county in the proportion . of one day’s imprisonment for every two dollars of said fine which shall remain unpaid, k SECTION XI. ; o The tax collector ot Nevada county is hereby authorized, empowered, * and required to collect all’ County ‘aq licenses, provided for and required a by this ordinance to be collected within the limits of sdid county® of Nevada, und it shall be the duty. of said tax collector to attend. to the collection of licenses, and examine all places of Uusiness and_ persons liable to pay licenses and to see that licenses are taken out and paid ‘for, He shall have and exercise, in: the performance of his official duties, the same powers, as police officers in serving process or summonsin makiat ing arrests; also shall have’and ex. ig ercise the power to administer sich ; oaths or affirmation, as:shall be peccessary in the discharge and exercise -f his, officia] duties; and he is hereby empowered to enter any place of business for which a license by this ordinance is provided aud required, free of charge, ‘at his pleasure, and to demand the exhibition of any~ license for the current time, from any person, or firm, or corporation ’engaged or employed in the transaction of any business for which a license is by this oiditance rendered necessary, and if such person, or firm, or corporation, or either of them, shall be unable, or refuse,’ or negleet, or fail to then and there exhibit such license he, she, or they, as the case may be, shall be deemed guilty of a misdemeanor, and on conviction thereof shall be punished . as provided by section 10 of this or‘ dinance for punishment upon conviction of a misdemeanor, SECTION XII, In addition to the penalty. herein prescribed for the hon payment of any license, the tax collector shall proceed to collect the same py civil action as is provided for by the provisions of Chapter 15, Title 7, Part 3 of the Political Code of Calitornia,and ‘the County Auditor must : prepare blanks and settle with the collector as now required by said chapter, ; SECTION Xu.
