Full Text of the Ordinance Adopted by the Supervisors.
“" ORDINANCE'No. 4,
The Board of Supervisors of. the
County of Nevada do ordain as fol:
lows :
SECTION I,
Every person, firm, company, or
corporation within the County of
Nevada, now engaged in, or who may
hereafter engage in conducting, transacting or carrying on any business in
this ordinance hereafter named, must
before, or at the time of engaging in
the same, procure a license therefor,
as provided for in this ordinance,
Each person, firm, company or e¢orporation so engaged, or’ who may
hereafter engage in such business
must procure such license from the
tax collector, and shall be liable to a
license tax to be collected by the
said (ax collector of Nevada County,
Such license shall be paid for quarterly, (except a¢ provided otherwise
in this ordinance) in advance, and
when issued, shall authorize the par
ty named therein to transact such
business in the said county. Separate licenses must be obtained for
each branch establistiment, or separate huuse of business located in said
county, Three calendar months
shall constitute a quarter,
SECTION It.
Auctioneers are divided into three
classes and must obtain licenses from
the tax collector as follows: 1—
Shose whose average monthly sales
amount to ten thousand’ dollars or
more constitute tke first class and
must pay a license tax of sixty dollars per quarter. 2—Those whose-averave monihbly sales amount to twenty-five hundred and less ,than ten
thousand doilars constitute the second class, and must pay a license tax
of twenty-five dollars per quarter
3.-Those whose average monthly sales
are Jess than tweuty-tive hundred
dollais coustitute the third class and
must pay a license tax of seven dol
lars and fifty cents per quarter.
SECTION IlI.
Persons engaged in banking, loaning money at interest, oc im buyiny
or selling notes, bonds or other eviences of indebtedness of private
persons, or in buying or selling state,
county or city stucka, or other evidences of state, county or city indebctdness, or stocks, or notes,
bonds or other eyidences of indebtedness of incorporated company; or
in buying or selling gold dust, gold
or silver builion, gold or silver coin,
are divided into three classes and
must pay liceuse tax aa follows:
I. Those doing business in the
aggregate to the amount of thirty
thousand dollars or more per quarter
constitute the first class, and must
pay a license tax of fifteen dollars
per quarter,
2. Those doing business in any
amount under thirty thousand dollars and over ten thousand dollars
per quarter constitute the second
class and must pay a license tax of
seven dollars per quarter,
3. Those doing business in any
amount less than ten thousand dollars per Quarter constitute the third
class, and must pay a license tax of
three dollars per quarter.
SECTION Iv, \
Licenses must be obtained for the
purposes hereinafter named, for
which the tax collector must require
payment as follows:
1. Proprietors of billiard tables,
not kept exclusively for family use,
must pay for each table five dollars
per quarter, © *
2. Theatre and other places of
amusement, must pay for each performance a license tax of two dollars.
4, .For each show for pay of any
figures, jugglers, nécromantvers, magiciaus, wire’or repe dancers, o:
-leight of hand exhibition, five’ dollars pet day. :
4, For each exhibition for pay,
for a caravan or. wenagerie, or any
collection of animals, circus, or othe:
acrobatic performance, ten dollars’
per day.
5. For each pawn broker fifteen
dollars per quarter.
6. \ For each toll road having a
toll bridge thirty-six dollars per
year.

SECTION Y.
1, Every person who sells spirituous, malt or fermented liquors or
wine in less quantities than one
quart, must obtain a license from
the tax cellector and must pay there
for a license tax of fifteen dollars per
quarter,
2. Every person who sells malt
or fermented liquors or wine in less
quantities than one quart and who
does not sell spirituous liquors, must
pay therefor a license tax of nine
dollars per quarter,
SECTION VI.
Every person who at a fixed place
of business, sells any goods, wares,
or merchandise, wives or distilled li‘quors, drugs or medicines, jewelry
or wares made of precious metals,
whether on commission or otherwise,
(except agricultural or vinicultural
productions, or the production of any
stock, dairy or poultry farm-of this
county when soli by the producer
thereof, and except such as are. sold
by, auctioneers at public sale under
license); and all those persons who
keep horses or carriages for hire, (ex
cept as are used in the transportation of goods), must obtain. from the
tax collector of this county for ‘each
pay quarterly therefor an amount of
money to be determined by the class
in which such person is placed by

under section six of this ordinance
must not be in quantities of less than
one quart measure; and further provided that no licence must be reqyired of physicians, surgeons,apothécanes, or chemists for any wines’ or
spirituous hiquors they may. ase in
the preparation of medicinés,

or peddler who carries a pack and
vends goods, wares, or merchandise
ofany kind other than the manufactures of this State must pay for a
license five dollars. per month; and
every such traveling merchant, hawker er peddler who uses a wagon, or
one or more animals, for the purpose
of vending such goods; wares or
merchandise of any kind, must
a license of fifteen dollars per month,
SECTION VII. :
Every person who keeps a. stallion or jack and who permits. the
same to be used for the ‘purpose of
propagatiou-for hire, must obtain a
license therefor from the tax co'lector of this county and pay therefor
as follows;
1, Horses that are hired for the
purpose of propagation, by the season,
at fifty dollars or more, constitute
the first Glass; and must pay a license tax of forty dollars,
2. At thirty doilars and leas than
ifty dollars constitute: the second
class and pay twenty-five dollars,
3. At fifteen doliars and less than
thirty dollars constitute the third
class and must pay fiiteen dollars,
4, Allat less than fifteen do lars
constitute fourth class and must pay
ten dollars, F
5. For each jack ten dollars,
SECTION IX.
For each license issued, the collector must collect a fee of one dollar
iu addition thereto which shall
all fees and expenses of collection, °
SECTION X.
It is further ordained that if any
person or persons, whether principal
or principals, agent or agents, clerk
or clerks,empioye or employes,or any
firm or any member of any firm or
corporation shall be engayed in carrying on, pursuing, or transacting
within the limits of the county of
Nevada, any business, trade, occupation, or employment, which is required to be licensed by the: provisions of this ordinance without obtaining a license therefor-as required
by this ordinance, or shall, after demand -refuse, neglect, omit, or fail to
comply with any requirement or requirements, provision or’ provisions
or orders of the said-Board-vf Sapervisors, requiring each person or persons, firm or corporation to procure
a license, he, she, or they, or either
of them, as the case may be, shall be
deemed guilty ot a misdemeanor and
on conviction thereof, shall be punshed by a fine not to exceed one
hundred dollars, and in default of
‘the payment of such fine shall be imprisoned in the County Jail of Nevada county in the proportion of one
day’s imprisonment for every two
dollars of said fine which shall remain unpaid.
SECTION XI.
The tax collector ot Nevada county is hereby authorized, empowered,
and required to collect all County
icenses, provided for and required
by this ordinance to be collected
within the limits of said county of
Nevada, und it shafl be the duty of
said tax collector to attend to. the
collection of hcenses, and -examine
all places of business and persons
liable to pay licenses and to seé that
licenses are taken out and paid for,
He shall have and exercise, in the
performance of his official duties, the
same powers as police officers in
serving process or summons in making arrests; also shall have and. exercise the power to administer such
oaths or affirmation, ‘as shall be neccessary in the discharge and exercise
of his official duties; and he is hereby empowered to enter any place of
business for which a license by.this
ordinance is provided aud required,
free of charge, at his pleasure, ‘and
to demand tbe exhibition of any license for the ciirrent time, from any
person, or firm, or “corporation engaged or employed in* the transaction of at'y business for which a license is by this o:diuance’ rendered
necessary, and if such person, or
firm, or corporation, or either of
them, shall be unable, or refuse, or
neglect, or fail to then and there exhibit such license he, she, or they, as
the case may be, shall be deemed
guilty of a misdemeanor, and on
conviction thereof shall be punished
as provided: by section 10 of this ordinance for punishment upon conviction of a misdemeanor,
SECTION XII,
In addition to the penalty herein
prescribed for the non payment of
any license, the tax collector shall
proceed to collect the same py civil
action as is provided for by the
proyisions of Chapter 15, Title 7,
Part 3 of the Political Code of Calilornja, and the County Auditor must
prepare blanks and settle with the,
collector as now required by said
chapter, : Sts
SECTION XIII. :
This ordinance shall take effect
and be in force on and after fifteen
days from the date of its adoption,
