the body of Henry Fry, who was

About 120’clock on the night of September 6ch, ZL was at the Pacific
Hotel; John Gilbert and Henry Fry
were present; Richard Pylard was
ilso present; soon some difficulty
arose between John Gilbert aud Pullard: Wm. H. Miicbell’ came in and
took Gilbert away: after this Pollard
said to Henry Fry; that he (Fry)
could have anything be wanted of:
him: Fry replied: “I don’t think
you can do much to me Pollard;”
Pollard said: ‘‘Phere are only three
of us here, let as close the doors;’’
and thereupon be (Pollard) went and
shat the door; after the door was
shat, Henry Fry who had gone bebiud the bar came out into the room,
standing at the end of the bar;, Pollird was standing two or three feet
from him; I had started to the door
to go out; I beard a@ pisto! shot; I
‘turned around and saw Pollard anu
Fry; I did not bear any outcry or
word from Fry after the shot. The
pistol was fired uf by Pollard.
Wm. H. Mitchell testified as follows; I hearda noise in the Pacific
Hotel; I went over and looked in: at
the window; saw Richard Pollard and
Jobu Gilbert in some difficuliy; I
went in and took Gilbert awuy; as 1
was taking Gilbert away Pollard
