That the said party of the first part, for and in
consideration of the sum of Ten Dollars, gold coin of .
‘the United States of America, to him in hand paid by
‘the said party of the second part, the receipt whereof
‘is hereby acknowledged, doth by these presents grant,
‘bargain, sell and convey unto the said party of the
isecond part, and to his heirs and assigns forever, the
South East quarter of the North East quarter of Section
‘Five Township Fourteen North, Range Bight East, Mt.
‘Diablo B. &. M. in Grass Valley Tp., Nevada Co., Cala.,
‘containing about forty sores of land.
There is a mortgage on the whole of the N E # of
said Section 5 given by the party of the first part
which mortgage held by Weissbein Bros. & Co. and the
debt secured thereby is assumed by the party of the
Second part, with the exception of seventy dollars
‘thereof.
In the event of foreclosure the NE + of NE ¢of
said Sec. shall be liable for said $70 & interest hereafter, & the balance of said quarter Section shall be
liable for the remainder due on said mortgage.
