PART L. TITLE I¥.—Of Crimesagainst the ' Blective Franchise. : Section.41. Every person charged with the performance of any duty under the provisions of any law of this State relating to ‘elections who. wilfaliy neglects or refuses to perform it, or who in his‘ official capacity knowingly and freudulently actein contravention or violation of any of the provisioné of such law is, wuless a different punishment for such an act or omission is prescribed by this Code, punishable by a fine not exceeding one thousand dollays, or by imprisonment in the State Prison not exceeding five years, or both. lec, 42.
