asking fora continuance of his trial
ufitil November on the grounds that
he has hot yet been abld to secure
the deposition of R. M. Fryer, who
is in New York city, states that on
‘Nov. 5th, 1878, Fryer contraeted to
payment to be creditedon the amount
due Sigourney by Smith ; that in
pursuance of the, agreement the
Smith mining company delivered to
Sigourney a deed for a mining-claim
on the Half Mile House property.—
If the sum was not paid Sigourney
was to consider the deed absolute
and eredit Smith with the sum of
$10,000. ~ He afterwards refused to
make this credit. \The affidavit further alleges that Fryer paid Sigourney $2000 which the latter refused

Up Country Freight.
The railroad authorities say that
the merchants in the upper part’ of
the county and through Sierra are
very slow this Fall iu ordering their
winter supplies, many of' them having not as yet done anything in that
direction. The result of thus delaying was experienced by a number
of dealers last season. Before their
goods arrived,the stormy season set
in, and they had much difficulty and
were put to extra expense in getting
them delivered,
