. Frank Johnson, the young man
who killed’ John Noyes at Quaker
Hill, and who is new in the Cotnty
Jail awaiting trial for murder, has
been kept locked up in an irdh tank
for several das and will hava'to Stay
there till his casé'is disposed of. He
had been aécorded the liberty of the
corridor util one day redéntly, when
Sheriff Tompkins dropped on a
couple of plans for.escape that he
was maturing. One vf them was to
have his young wife. smuggle into
him a loaded revolver. When he
got ‘possession of it he was to change
clothes with another prisouer who is
a trusty, and pulling the hat down
over his face and with a slop pail in
his hand walk out of the corridor
door when it was opened, If he was
detected in the act he had determined to kill whoever stood ‘in the
way and thus secure liberty. Another proposition he had under consideration in case this did not work,
was to prevail upon the jailer to loek
him up fora night in one of the cells
where a bar is out of the grating,
leaving an aperture perhaps large
enough for & small man to slip
through. Once in that.cell he intended to remove his clothing, grease
his body, and slide out by way of
the grating, _ He cannot get out of
the place. he is. now in without reducing himelf to the thinness wae

Peace on the Street and is Sent

F. Kleupfer was brought down
from Truckee yesterday and locked
up in the County Jail for-a term of
24 hours in default of a hundred
dollar fine imposed on him by Justice
Dunster because of alleged contempt of court. ‘Last week the
prisoner was working on a building

Upon his arrival Mr. Kleu; fer engaged C. W. Cross as counsel, and
through him filed application for a
writ of habeas corpus ‘setting ‘forth
in substance as follows:
“Said imprisonment is on ‘a warrant that does not show it is for con~
tempt of court. ‘The facts of the case
are that said petitioner hada personal
altercation near the Plaza-with Dunster and Kleupfer hasnever been cailedupon to show cause why he should’
not be pitmished for contempt; that
he has never had a hearing; that
none of said acts were cominitted in
any court, nor has there ever been a
hearing of said matter,” :

Caldwell iss the writ of habeas
corpns and he released.
