Saami The case of Mr. Kennedy vs, the Ruby Drift Mining Company of Sierra county, wherein plaintif ask‘ed for an injunction to restrain defendant from fouling by mining tailings a stream that leads from the Ruby mine past Kennedy’s ranch, has been compromised. According to the terme, the Company can go on prospecting til! April first, and if after that time they desire to continue their work they must pay to Kennedy a specified sum of money per annum, Ifthis kind of a thing goes on, the time will assuredly come when every quartz, drift and hy« draulic mine in the State will be compelled to pay tribute to the ranchers below them, or else be enjoined, What a glorions field would be opened up for blackmailers ! a] A Good Idea, . All persons interested as expectant heirs or otherwise must then question the testator’s sanity or forever hold their peace, A will admitted to probate during the life vf the maker, cannot be conteste! after his death on the ground of his alleged mental capacity. It is contended that the law works well and has prevented much useless and expensive litigation. The Jawyers have in vain tried to have it declired unconstitutional, as it seeminyly interfer.s with their business. How would a similar law work in California?
