In calling the attention of the Chief
Executive of the Nation to the necessity of again permitting tha. working

State, to the end that $10,000;000 now
annually lost to the State and to the
country under judicial decisions prohibiting that great industry, migit be
utilized, the Governor is eutitled to
the thanks, not ‘only of the mining interests of the State and the thousands

population of the foothills which onca
prospered solely by it and would
again.feel the thrill of progress by its
revival. In his message to the Legislature. four months ago Governor
Markham said: ‘Hydraulic mining
is at a standatill, and will never’ .be
renewed unlesa vigorous steps be
taken by the general Government,”
There are tens of thousands of square
niiles in the Sierras undeniably—rieh
in~beds-of-gotd*bearing gravel. On
account of the law ayainst. hydraulic
mining, which was a result of the war
between the farmers of the valleys
and the miners of the mountains, the
annual output of gold in California has
foothills counties have lest more than
50,000 in population, without saying
anything of the enormous decrease in
the Assessor’s valuations of property.
‘How to permit this great industry to
continue without detriment to the
agricultural interests of the valleys
has been the perplexing question with
engineers, miners, farmers and the
officers of the national and Stute governments, There is no question that
there are and have been most important equites in the Claims of the farmers, which are acknowledged by the
miners, whose Contention is that the

present law practically confiscate

‘The farmers themselves appear to
realize this, for at the recent session
of the Legiclature they made no opvosition to the passage of a law whicli

Che practical effect of that law will be
to allow a change of venue. There
are other and more abundant signs of
waning hostility to the miaers upon
the part of the farmers, and the conclusion has been of late dawning. upon the public mind that the true solution of the great question lies with the
Government of the Upited States, and
in im; ressing upon the President, in
the hope, doubtless, that referente
will be made 'o it in~his message to
Congress next December, Governor
Markham has done a great service to
the State.
What action should be taken by
the general Government to revive the
mining industry, and particularly hydraulicking? The answer is a simple
one—by the general Government,
possibly with State assistance, in the
construction of dams, making effective appropriations for scouring the
rivers upon a broad and comprehensive p'an framed by the engiveers of
the Gevernment under which dams
for the impounding of the debris
could be constructed so as to prevent
injury to the lowlands or the river
beds,
The importance of the question has
been fully recognized by the National
Government, as Congress in 1888 enacted a law authorizing the Secretary
of. War to appoint a commission,. consisting of three officers of the army,
for the purpose of inquiring into and
reporting on the extent to which the
debris from the hydraulic mines had
obstricted the navigation of the San
Joaquin, the Sacramento and_ the
Feather rivers, and damaged the
farming lands along those streams and
their tributaries. The Secretary -o!
War appointed Majors Benyaurd,
Heuer and Hanbury of the Engineer
Corps. Unfortunately, the appropriation of $10,000 was ridiculously inastequate for the purposes of the Commission, and their work was necessari-ly confined to what was little better
than observation and. :econnoissance,
if I may be allowed to use that term;
but for all that, so prolific is the data
npon the subject that the Cominissioner whose report has just been
published has made many valuable
observations and suggestions.
