Says the Marysville Appeal of Friday: There is no doubt that the

The company owning that mine is the
defendant in a suit bronght by the
United States, now pending in Judge
Sawyer’s Circuit Court. The testimony
for the plaintiff is all-in, and itis very
strong. Witnesses have testified that
the river immediately above the mine
has been clear, while just below the
mine the water has been yellow with
slickens. The plaintiff has sought to
establish two main pointe. First,that
the restraining works of the company
are insufficient, and secondly, “that
slickens is from time to time; as opportunity, offere, discharged directly
from the mine into the river, without
any effort -at restraint.
There has been much delay. in the!
taking of testimony in this action, before the Commissioner, om account of
illness of several—of the parties concerned. The only witness so far called for the defendant is L. L. Rebinson, and the taking of his testimony
is to ‘be resumed’ shortly. The testimony will probably be submitted to
Judge Siwyer before the close ‘of the
year.
What is known as the Woodruff
suit is a separateaction from that now.
in progress. In the Woodruff suit
two cases of contempt against the
North Bloomfield, for violation of injunction, are pending in the Circuit
Court. Like the testimony in the
new suit, that in these proceedings for
contempt is strong. :
Mr. Ohleyer says that the North
Bloomfield is the only mine of.any
consequence that is known or believed
to be discharging debris into the Yuba
river. The Feather and Bear have
been clear all summer.
Tone’s New Institution.
As-heretofore stated, the cornerstone of the Preston School of Industry
at Ione, the State institution provided
for by the last Legislature, will be
laid on the 20th inst. This main
building is to have a frontage of 168
feet and an extreme depth of 175 feet.
The structure will bethree and one
half stories in height and will be
built of Sacramento stock brick, a
grade between pressed brick and’ common brick, with sandstone trimmings.
This is to be crewned with a tower 140
feet in height. Subsequently a small
village ofeight or ten detached cottages, a chapel, workshop, barns,
stables and a power-house will be
constructed, The Legislature appropriated $95,000 for the work. This
will not be sufficient, and an additionalappropriation will be asked. The
present work contemplated will exhaust $58;900.
Been There Befere.
When Sheriff Dunster arrived at
the Stockton Asylum with Wm. Allsop, the insane-man from Bronco,
the authorities at once recognized Allsop as a former inmate of the institution. He was discharged from there
in April last, it being believed he had
permanently regained his reason.

held its regular weekly meeting last
night and presented a very good program. The debate was on the question, ‘Resolved, That Farming is
Preferable to Mining.’? Ex-Assemblyman Hill pleaded the negative
cause and Mrs. Church (nee Brown)

judges was in favor of the lady.
It is currently reperted that at the
meeting of the Board of Education
next Monday evening, charges (embracing that of incompetence) will be
preferred against a teacher by a superior officer of the school department,
and that the teacher in question will

in an unnecessary manner (choking)
