Chroniéle of Monday:—Senator Berry
of Arkansas, one of the conferees on the
hydraulic wining bill, acting, as he-says;
under an express promise made to his
cousin, ex-Cengressman C. -P. Berry-of
this State, has tied up the hydranlic miaing bill in conference, because he would
hot consent te a modification of the penal
‘clause of the bill on which the rest of the
conferees have agreed. Five out of six
of the conferees want to amend the penal
clause so that it shall read: ‘‘Any person ér persons, company or corporation,:
their agents or employes, who shall mine
by the hydraulic process, directly or indirectly injuring the navigable waters of
the United States in violation ofthe
provisions of this act shall be guilty of a
misdemeanor,” the change consisting of
the insertion of the clause beginning with
the word ‘‘directly,”” but to this C. -P.
Berry objects, and his cousin, Senator
Berry, upholds him in his objectiori.
A very good argument might be made,
we imagine, against a Senator of the
United States setting up the judgment of
his cousin against the deliberate opinion
of such men as Senators Stewart and
Mills and Representatives Cowles, Tewnsed and Caminetti; but it may be bettér
te waive that and request C. P. Berry te
explain to the people of California why
he persists in holding bis Senatorial
cousin te the strict performance of his

Ex-Congressman erry was seen last
night, says the Appeal, and “was shown
the telegram from Washington in the
San Francisco. Chronicle, in which Congressman Caminetti appears to have a
grievance. He did not care to be interviewed in relation to the telegram, for
fear that Caminetti might have heen
misrepresented in the dispatch. ~He
‘expressed the belief that the measure
would not now go through and that the
miners and their representatives were
playing an artful dodge and trying to
shift the responsibility of the defeat of
the measure, first upon him and then
upon the farmers,
Mr. Berry, after a consultation, tele:
graphed to Caminetti, stating that if all
the modifications’ desired were as indicated in the dispatch that the people
here would have no objections to them.
He also telegraphed the same to his
cousin, Senator Berry of Arkansas,
