When G, W. Gibbs left the witness stand on the morning of the , lastday when the case came up, Le} did not return ia the afternoon, and the attorneys forthe company were approached by Mr. “Wilson, who represented the defendants, and a financial settlement was suggested. The Proposition was taken under advisement, and the Company was sul sequently advised that in view of ihe fact that the defendants, Geo, WwW, Gibbs, Egbert Judson and A. P. Hoteling, were one and all wealthy then, and the Company poor, it would be judicious to settle the matter. The suit was eventually adjourned, and arrangements are now being carried out under which a settlement can be effected. Itis alleged that-six successive dividends of thirty cenis per share were paid by the Company while ‘iron was being produced at $50 per ton and sold at from $22:°50 to $25. The stock waboomed as high as $37 to $39 per share. Charles Webb Howard cf the Spring Valley. Water Company. is one of the heaviest sufferers, having purchasedin open market over. 80,009 shares of the company’s stock. Within fifty days after the date of the last dividend an assessment of $5 per Share was levied, and sub-eqnentl, two others of $1 per share. Then the “property was mortgaged for $150,000, of which $89,000 was reported sold, ; the Directors taking all the “bonds . themselves except one share which by some inexplicable means drifted on the outside. This mortgage they are now trying to foreclose, although. the Property owned by the corporation is estimated at $325,000.
