Yesterday’s San Francisco Examiner prints what purports to be an account of the examination at Truckee of Malcolm McDougald, charged with Michael Lenahan’s murder. The article is a shining example of what-a reporter with a strong imagination and an ambition to spread himself can accomplish when he tries. He says : There being no courtroom in Truckee sufficiently large to hold all those who desired-to attend the hearing, Justice Leggett picked out the most spacious apartment inthe town. It was a barroom. An arrangement was entered into with the pr proprietor of the establishment whereby the representative of the law agreed ‘that profitable castomers of the bar should not be found fault with. The arrangements were entirely satisfactory to all concerned. It. was next agreed that everybody should drink and smoke as much as he desired, but that if he interfered with the peace and dignity of the court he should be ejected. The home of justice was packed to suffoeation. There were chairs for the Court, the counsel and the defendant, bué. the spectators were requested to distribute themselves on the stock in trade “of the saloon. They’ sought barrels, poker tables and the floor. On opening: court Justice Leggett said, ‘‘Let’s irrigate.” The court adjourned to the other side of the room and complied with Mr. Leggott’s invitation. Lemuel . Stratton, a gentleman of leisure in “Truckee, remarked, ‘‘The Judge isa bleed if-he dees-have-te-try-peaple-”” Then the trial of McDougald began in deadly earnest; The prisoner, pale, but calm as a summer’s day, sat beside Constable Jacob Teeter listening to all the testimony adHe was a typé of the border town . barkeeper—handsome, flashy and cdol. A diamond flashed upon the little finger of his right hand and he twirled his mustache as nonchalantly as if he were mixing-a morning-cocktail for a customer: The looks that were cast’ upon him, however, were black and ominous. The audience was made of determined and dangerous men, big stalwart fellows, who nad come down from the Sierras to see fair play. The dead man, Lenahan, had’ many friends during his life, and they wanted justice, as they called it, meted out tohis slayer. $ The first two days of the examination passed off as quietly as might be expected under the peculiar existing circumstances. ~@ne witness, Who had presumably been in the saloon when the fatal blow had been struck, admitted that he had been in the place for at least forty-eight hours. He had neither seen nor heard anything, and the prosecution showed that he had gone on a drunk on the 4th of July and kept it up most industriously for two days. The shots, which it is alleged were fired a short time previous to the killing, only two feet away from him, he never heard. “J wouldn’t have heard a cannon,’”’ he aaid candidly. Another witness was comfortably full when he saw the fatal blows struck, and was in a similar condition when he went on the stand. “Tf they don’t like it, I can’t help it,” he remarked, when a friend objected. On the third day of the hearing an old gambler, who had loved the dead man during his life, created a sensation. He isa perfect type of the men Bret Harte made so famous. “T loved Lenahan,” he said, addressing acrowd outside the courtroom on Monday, ‘an’ I rome to see that this thing goes right.” A moment later he stopped into the barroom where the court was in session. In order to find out if Lenahan had really fired the shots it was ordered that the cartridges be extracted from his revolver. One of the spectators to oblige his Honor started to perform the task. At this moment the dead man’s friend rose up and said: Hold on, I’ve something to say about “pare frequent. McDougald crouched behind the Constable likea tiger at bay. The knife flashed in his hand and his eyes glittered. His face was white, but a determined look rested upon it. ‘Give me a show!” he yelled. ‘‘Protect me or give me a gun to. defend myself.” It wasa thrilling moment. Two or three men were appealing to the friends of Lenahan to retire, but the crowd was drawing closer to the prisoner. ' Justice Leggett did something brilliant and undoubtedly saved McDougald’s life. ‘‘Let’s take a drink,” he yond, moving to the bar. The invitation was accepted with a cheer, the pistols disappeared and Lenahan’s friend was pushed out on to the main street of Truckee. Quarrels, though, The lawyers fight with discretion, for friends of both sides are constantly present armed with the latest improved self-acting revolvers. HIGH ALTITUDES. Mining Camps Over 15,000 Feet Above Sea Level. . . Ithaslong been supposed that Galera, a village in Peru, 15,563 feet above the sea, was the highest inhabited place in the world. Arthur Pearce, an engineer, “who has been prospecting and making meteorological observations in the Andes, has discovered two mining camps that are even higher. These are Ticharrayac, 15,950 feet, and Muccahata, 19,158 feet and more above the sea level, each witha population of miners averaging 200 the year round. High as some of the. points are on the Panama Oroya Railroad of -Peru, of which the Galera tunnel is the summit, that road will be surpassed by: a narrow-gauge railroad now under construction toconnect withit. This, when completed, will have a length of seventyfive kilometers and mean altitude of 15,850 feet. In one of the mines a tunnel is being driven at a higher elevation than Galera, which, when completed, will be fully as long, if not longer, than that tunnel. This work is being done by means of compressed air drills, and the tunnel is lighted throughout by electricity. : DIXON WINS. Out. the Australian In Four Rounds.
