canceled, and for such other relief as is
agreeable to equity.
For cause oF action plaintiff allezes that
on September 1th, 1886, defendant Todd recovered judgnient against said corporation
defendant, in Department 1 of the superior
Courtofthe City and ounty of San Francisco, said State, for the sum of $2769 6-100, and
by virtue of an execution issued on suid
judgment, dfrected to the sheriff of Nevada
County, California, said Sheriffon the .th
day of October, 1586, suld all of said property
in one parcel. That defendant Sweeney on
the sth day of peplaniber, 1886, recovered a
judgment against suid corporation defendant in Department 4 of the Superior Court of
said City and County of San Francisco for
$1225 64. That defendant Marshal recovered
on the Ath day of September, 1886, a judgmentin Department i of the Superior Court,
said City and County, for $3488 55. That
said Marshall on October 0th, 1886, purchused from suid Sweeney his said judsment,
and on the 13th day of pctoker, 1856, paid to
the Sheriff the sum of $300.to redeem said
roperty from suid execution-sale. That on
he 1-th day of March, 1887, plaintiff recovered a judgment in Departinent No. Two of
the Superior Court of said City and County
for $5.8 38-100, Thaton March ly, 1837, said
Marshall filed for record in the office of the
County Recorder of Nevada County an in«#trumentin writing purporting to be a sale
to defendant Sinith of his said judgment.
