send Greeting to Caleb Harrington, Defendant. Youare hereby required to appear in an action brought against you by
the above-named Plaintiff in the Superior
Court of the County of Nevada, State of
Californis, aud to answer the complaint
filed therein, within ten days (exclusive
of the day of service) after the service on
you of this Summons, if served within
this County ; or if served elsewhere, within thirty days ; or judgment by default
will be taken against you, according to
the prayer of said complaint. The said
action is brought to recover the sum of
$301.77 alleged to be due from Defendant to Plaintiff for money_ expended by
Plaintiff in perfecting and acquiring _title, andin necessary expenditures for
taxes, labor, improvements, mining tools,
machinery appliances and assays of gravel, over and above receipts, in that cer,
tain mini claim, owned jointly by
Plaintiff and Defendant, known as the
Holbrooke and Harrington Gravel Mining Claim, situate in Secs. 19 and 20, T.
16, N. R, 8 E. M.D.M., Rough & Ready
Township and. Mining District, Nevada
county, Cal. Plaintiff prays for an accounting between Plaintiff and Defendant as
owners or tenants in common of said mining claim and that upon such an accounting the Defendant be adjudged and
decreed to be indebted to Plaintiti in the
sum of $801.77. That decree of this
Court be made directing the sale of the
whole of said premises, and that the proeveeds of said sale be applied, first,
to the payment of the costs of
this proceeding, including: reasonable
e@ounsel fees, second to the payment
to Plaintiff of the saidsum of $sU1.77,
and that the residue of the proceeds of
said sale be divided between and paid to
Plaintiff and Defendant share and share
alike. Plaintiff prays for general relief.
