Superintendent Spauding of the
South-Yuba Company says~that-the
Idaho Mining Oomp.ny’s damage suit
against the former corporation is not
the result of any bad feeling between
plaintiff and defendant, but to settle u.
question oflaw, The contract between
the South ‘Yuba and Idaho Companies
relative tosupplying water tothe latter expired last July. While it was
still in. foree.the. South: -Yaba--Oom*
pany made a similar contract with the
Empire Mining Company, but made it
subject to the contracts with the Idaho
Company and J. E, Brown who. supplies-the town of Grass Valley, so far
as~precedence--inbeing entitled to
water went. Mr. Spaulding says whien
the period of the agreement with the
Idaho folks elapsed, he then consider
ed that the Empire company’s right
to water became greater than. the Idathe head in'the ditch so there was not
enough water for both companies he
gave the Empirea larger supply than

Opening the Washington Read.
Marsh Brothers, the lumbermen,

begin the work of opening the Washington road from this city ‘a distance

snowfall of two feet at his place. He
is located where there is seldom any
snow. In 1853 there were regulur
rains up to the 10th uf July, just like
in climates of the Eastern _Siates,
These spring and summer rains were
accompanied by heavy thunder and
much lightning. In 1855 the winter
was extremely cold; the winter of
1856 was splendidly mild. In 1856
the grass was green, the earth covered
with flowers and the manzanita trees
were in bloom at Christmas. The
season of 1875 was another open winter
and the cattle did well al! the time.

set apart in the public schools as

Arthur Myers of Cherokee, a teamster who is also known as “the Snow
Conqueror,” nearly met his Waterivo
at this city Thursday. He had a
light wagon drawn by six horses, and
loaded at the railroad depot for Colum:

Ricketty Awnings.
A recent Supreme Court opinion,
in-thecase—of—Riley ve.-Simpaon. &
Gray, deals with the responsibility of
owners of buildings, in front of which
awnings are erected. The plaintiff,
walking under an awning owned by
the defendants, was caught as it: fell.
The plaintiff was awarded $5000 dam4ges for injuries caused by the fall of
the awning, and the Supreme Court
affirms the judgment, holding that the
owners Were guilty of negligence in not
maintaining their awning so that it
should not be dangerous to pedesttrians. There aresome Nevada City
property owners who might in view of
‘this decision find it worth while to
look after the awnings in front of their
buildings.
