Silvia Galavotti, superintendent of the Derbec drift gravel mine, was shot by, a highwayman and instantly killed this morning while bringing to this city for shipment to San Francisco a bar of gold bullion worth between thousand dollars. Mr, Galavotti and J. D. Ostrom, the North Bloomfield liveryman, left the mine at 7 o'clock in atwo horse buggy, to bring down the semi-monthly clean-up, as has been the usual custom for a number of years past. In the vehicle with them was rifle carried by Galavotti. They were ascending the steep grade this sideof the South Yuba river and about 64 miles from the city. The horses were walking. Ostrom was driving, Galavotti sitting on the side next to the upper bank which rises precipitously at that point. Suddenly a gunshot was heard on the bank from twenty to forty above the road, Ostrom at firat thought Galavotti’s gun had been accidentally discharged. A bullet had entered his face at the left side of the nose, and he was falling put of the buggy when Ostrom grasped him. He died immediately. His hat and rifle fell into the road. An instant later a second shat was fired and this time thé ball piercéd the neck of one of the horses, but did not bring it down. The robbers were not seen by Ostrom aor did they speak. Ostrom with remarkable presence of mind struck the horses with the whip and they sprang forward. Holdthree and four ie nerve and vehicle with one hand he urged the spircted animals inte a run and passed quickly around a turn which took him out of cange of the shooting. He drove tothe Kirkham house (Mt. Vernon) at the top of the grade half a nile above where the shooting occurred. fnen unhitching the horses he took the uninjured one and riding into town at a break-neek speed arrived here-at a few ninutes past nine o'clock, bringing news of the brutal butchery. The most intense éxcitement was creatad. The _officers.and_a-large numberof other men_hastily armed themselves and ieft for the scene of the crime. Under sheriff Sheriff Schmidt also sent telegrams co North Bloomtield, North San Juan and »ther points along the ridge warning the stficersa and citizens to be on the lookout for the criminals. A wagoli was sént to Mt, Vernon to uring in the corpse which arrived shortly vefore one o'clock and is now at W. C. droves’ undertaking rooins. The Transcairr sent a telegram to fheo. Wetzel, secretary of the Derbec Company at 320 Sansome street, San Francisco, notifying him of the killing and asking what reward would be given by the vompany for the apprehension of the robbers, of which there were probably swo, although Mr. Ostrom inclines to the velief. that:there was but one. Mr. Galavotti was a native of France aged 43 years, He Idaves a wife, but no children, He had been in gharge of the Derbec for a number of, years, and was one of the best gravel miners on the coast. He wasa first-class man in every way, and the indignation of the community over his murder knows no bounds. , The Bloomfield stage that came in this afternoon brings word that ex-Marshal Neagle who is one of the searching party found an empty cartridge at the scene of the shooting, also discovered the track where one man came down from’ the hill where the shots were fired from and crossed the road. County Coroner Gray is holding a post mortem with the following jury: John Grissell, E. Bond, E. J. Rector, J. Gallagher, T. J, Ramsay, H. A. Lord, H. Guenther, John Vail and Wm. Hoskins. The State offers a standing: reward of $300 for the arrest and conviction of each highwayman. District Astorney Nilon has telegraph: ed to the Governor asking him to offer a liberal special reward. A Trust § Suit. Geo. G. Allan by y his attorneys, A Burrows and C,.W. Courts and Judges of the Great Metropolis, Some Pointers About Our State Supreme Court, The Transcrter editor insists that an article relating to the Courts and Judges of San Francisco would be acceptable to its readers, which is indeed an indirect way of complimenting them. In our land the Courts are the nearest thing we have to Kings. They have as much power over lifé and property as Victoria. They virtually make laws by this power in construing Statutes, and they unmake laws by declaring them unconstitutional. This is no doubtall for the best, for “boodle’”* Judges are much rarer than ‘‘boodle” legislators, while stupid Judges are not more numerous than stupid legislators—proportionately speaking, of course. In spite of Buckleyism and machine politics, San Francisco manages to elect, term after term, a splendid lot of Superior Court Judges. This 1s due no doubt largely to the Bar Association—a powerful organization of ‘sufficient influence to defeat the election of any incompetent or improper nominee. To this is added the vigilance of the press, which maintains an eagle eye on the deportment aud decisions of the various judicial officers, and has courage to criticize and even denounce unjust decisions, The recent act of the Legislature providing that no newspaper can be adjudged guilty of contempt for: criticising thé conduct of any Court, has brought the Judges where they ought to ever be in ‘a free country,—subject to the criticism of the Press. Every man has in him, at times, something of the arbitrary nature of a .Nero, unless some check is placed upon his conduct, and publie not an unnecessary check on the arbitrary tendencies of any opinion is public officer clothed with diseretionary The failure to checks has recently defeated the hopes ot one judicial officerin. San Francisco for re-election, and caused those in office to feel that they are closely watched. From this cause as well as from the care exercised.in the nomination of Judges ‘‘slouchy” decisions and power. observe these there are far less bad judgments in San Francisco than in the balance of the State. Of course some ~oases™trivd ero reversedsbut ib isniwst ly on some fine technical pointand nyt for the outlandish blunders that characterize so many of the appealed cases from vountry Courts. Indeed it has passed into a proverb that the decisions .of two-thirds the country judges may be safely présuméd-to-be erroneous;-and-reversable on appeal. No one claims that this is caused by wantof legalacumen. The San Francisco Judge, is selected for honesty. legal ability and cold-blooded impartiality; with little regard to his politics, while country Judges ave oftenest selected for their polities, their sympathetic . disposition and Other such traits, which are really more: disqualifications than anything else. They ‘are impartial because they are cold-blooded and ‘grind out” clean legal justice like fine wheac from the mill. No suitor would ever dare to-speak to any of them about his case except on the bench, and the disreputable practice of ‘‘stuffing” the Judge or some of his family with a litigant’s ‘‘tale of woe” is unknown, Indeed it would ruin the reputation of any of the Judges to tolerate such a suspicious custom. : The rules of practice are in many respects different from the Country Courts, and are pretty rigidly enforced. Twenty minutes is the time allotted for arguing a demurrer‘or motion, and one hour for ar guing a case at the trial. He,who files a demurrer must be present on law day (without notice) to argue it, or it will be overruled, as if abandoned. An attorney appearing for a defendant in a' divorce case must in many cases give proof of his authority to appear. Attachment bonds must equal one-half the amount of the debt sued for and the insolvency proceedings follow the old Bankrupt rules of the United States Courts. In all I believe there are about fifty rules of Court aimed . at the convenient dispatch of public. business, and it cannot he doubted but that they aid largely in making the Courts so efficient, San Franciseo Courts permit of no trifling with their authority. Where the law has spoken it is enforced and when discretion is allowed, such discretion never degenerates into mere sentimental caprice or monkeying with the machinery of Justice, Asa result it stands both feared aud respected alike de the public and the bar. There are several. other reasons for the superiority of San Francisco Judges. The first of these is that on all knotty points they have opportunity to consult each other before rendering a decision. The second reasonis that they cannot get “rusty” on any department of law, for want of abundant practice; the third is, they seem to adopt @ more perfect rule of S. Now, any Judge or even schoolboy van decide a case in law where there is a Supreme Court decision on a plain Statute directly in point. It requires no skill whatever. There is seldom even any contention in such cases. But the majority of cases involve one or more points not directly covered by any Statute or any decision. What will. the Court do in such ease? If the Judge is a ‘‘thorough-bred,” failing to find a case or Statute, directly in point, he will at once fall back on the only other legal source that is left—the doctrine of the maxims and analogies of law. Throwing aside all his own notions he will follow these out to their logical conclusions and embrace the yesult in his decision. . To do this he must be well read in law, something of a logician with a mind beyond the control of his own prejudicés,—in a word a thoroug] « bred Jurist. Where tliis exists the custom of attempting to win a cause by the old-fashioned loud mouthed howling, speedily fallsinto ‘innocuous desuetude.”’ What strikes a visitor at_the_trial_of . Tost of the casesin— the San Francisco Superior Courts, is the rapidity with which trials are conducted and cases rushrushed through. . It is not an uncommon thing for several cases to be tried on the same day. The lawyers aré always welcome to discuss points of law, but the tedious and ridiculons reiteration of the testimony, is not permitted—the Judge or Jury being supposed to have as guod a memory as the attorneys. Where the Judge considers discussion of a point superfluous, he perverts a waste of time by promptly so intimating, and requesting the speaker ‘‘to go on to the other points of his case.” The modern method in which the Court interrogates the counsel, on points suggested by his address, is generally adopted. Of course this sometimes ‘‘breaks the line of argument,” but itis.of vast advantage in affording an opportunity to the speaker to discover the ‘‘lines of thought” in the mind of the Court, and is @ sure indication that his honor’s brain has not gone a ‘‘wool gathering,” or worse yet, fallen asleep. is not the slightest doubt but that this ‘custom, now: adopted by the highest Courts of both this country and England, tends tos promote justice and intelligent ajudications. Of course it is not favorable to ‘set speeches,” but is far less irritating, however extreme, to the dreary task of talking for fidiirs:to a being that sits on the bench like a statue. It ia I think admitted by the legal profession_that the majority_of the State 3upreme Court are as able jurists as. can be found anywhere in the United States. several of them are young men full of vitality -and-all-ef-them; save one, ~ite-the-} prime of life. The-eriticism mostly urged against them is a disposition to decide eases contrary to the “decisions of their words ‘to ignore stare decesis. This is just what the press has been howling. for, during the past twenty yearsand seems to be in accord with recent. legislation abrogating the rule known as ‘‘The law of the ease,” which means that a.rule once made in case can never afterwards be changed. Among the Supreme Court Commissioners none is earning higher praise than ex-Judge Van Cliefof Downleville: ~ Long before he became commissioner Van Clief was recognized as being the ablest mining lawyer on the Coast, barring Senator Stewart, and his decisions while commissioner amply bear out his well earned reputation. Speaking of our Supreme Court decisions, remind me of something fhat is not generally known, to» wit: is written and approved by the Court as part and parcel of the decision, and often passes. on a point of law essential to the case at bar, but sometimes omitted from the body of the decision, Thisbeing the fact the syllabus is sometimes as importantas the case itself and is always a authentic. — By general consent itis admitted that
the majority of the recent decisions of the Supreme Court are too lengthy by half aud waste an immense amount of paper and printers’ ink. They often occupy a dozen of pages in passing on a point that could as well be decided in half the space. Of course itis claimed that in so doing. they are merely following the present constitution. It reminds me of the objection that a miner made to thw election of a certain lawyer, noted for his long-windJ ed deed and documents, to a public office, “Why,’ said he, ‘‘in less than six months he will haye the office filled up with par pers.” Beyond all doubt our Supreme Court is using up lots of paper. This morning, in thg Superior Court trial of the case of Walrath et al. vs. Maryland Mining Company, a recess was taken till tomorrow morning owing to the absence from town of witaess Uren, Mrs. Kate Sandow yesterday paid the fine of $30 imposed upon her several weeks agowhen she was convicted in Justice Mulloy’s court of stealing irrigating water.
