The Poople’s Party Not to Be Named a} the Ticket’s Head ° Attorney General Hart publishes a reply to Secretary Waite in which the latter officer held that the People’s party was entitled to recognition at the head of the new reform ballot to be used at the coming election. General Hart’s opinion is backed up by numerous and long quotations from the law and courts decisions, by which he arrives at the following conclusions : “It is thus plain to my mind that the People’s party, so called, is not entitled to a heading on the State ticket, and to insert one might invalidate the whole ticket. Ifthe so-called People’s party nominees obtain signers amounting to 5 per cent. of the voters its nominees would be entitled to be inserted on the ticket in places and following their names the words, ‘People’s party,’ to designate their principles, and then if at thi@election their canilidates should receive 3 per cent. of the votes cast at this election it would be creating.a political party, entitled to call a convention two years hence for the purpose of nominating candidates in accordance with the provisions of Sections 1186 and 1187. That is to say, the vote at this election of 3 per cent. for their candidafes and party wonld establish it as a political party entitled toa heading on the ticket at the next election, and it is only in this way that a new political party cari? be created. “The only parties entitled to a heading on the State or ‘‘general ticket” at this election are: Regular Republican ticket (straight), regular Democratic ticket (straight), regular Prohibition ticket (straight), and no others, All nominations made by certificates or conventions for. Assemblymen, Senators and Congressmen and fer county officere-eutsideof San Francisco by socalled parties other than the three above are not entitled toa heading on the ‘‘general ticket’ but must be entered on the ticket in their respective places, as follows : “John Smith, Non-Partisan, *‘John Doe, People’s party, And so on, none of whom would be éntitled to a heading on the general ticket. You can readly see that the nomination of John Smith, Non-Partisan, for the Assembly entered on the general ticket with a heading would have the effect of misleading. the voter who voted for the heading, for he would lose-a vote for all other officers but John Smith, Assemblyman, and this would be a fraud on the elector. “County Clerks of the various counties of this State and the Registrar of San Francisco have no right to have printed a heading on-the general ticket other than is certified by you, and you ought not, under*the law, to certify any heading for a ticket other than the three above specified. ; “Tf you give a so-called party a headingfwhen it is not entitled to it all votes cast for such a heading would be lost and of no effect and might invalidate the whole ticket, As a matter of fact, the so-called party heading at the top of the cordance with the Australian ballot systan! : Attention N. 8. An Ordinance to License Auctioneers and merchants commencing business, and to regulate the carrying on of said business. HF. Board of Trustees of the City of Nevada-do ordain as follows: ~ : SECTION 1, Any person or persons, company or corporation, conducting or carrying on the business of auctioneering or selling goods, wares or merchandise or other things at public auction within the corporate limits of the city of Nevada, shall procure a license therefor as hereinaiter provided : SECTION 2. Those doing a business whoge sales amount to $5,000 or more per quarter, are auctioneers of the Ist class. Those whose sales are less than $5,000 and over $3,000 per quarter, constitute the second class. Those whose sales are less than $3,000 per quarter constitute auctioneers of the third class. SECTION 3. Auctioneers of the first class shall pay an annual license of $175. Those of the second class shall pay an annual license of $125, and those of the third class shall pay an annual license of $75. All licenses shall be paid for annually in advance, and shall be issued by the City Marshal, and the amounts collected shall be paid into the City Treasury, and no license shall be issued for less than one year, ‘ SECTION 4. All li¢enses issued under the previsions of this ordinance shall be non transferable and it shall be unlawful for any Auctioneer licensed under this ordinance to lend his name or assistenve to any other person or auctioneer, when such action is taken for the purpose of attempting to avoid the payment of an auctioneer’s license by such other person or auctioneer. Traveling merchants, salesmen, or any person or persons who commence or open up any businsss by which goods, wares or merchandise of any kind are'toybe sold or bartered, which is not otherwise licensed, shall procure a license and pay therefor the sum of $50 before commencing or opening said business.
