salé or his assigns before said judsment is
rendered, that said Sheriff's deed be also
canceled, and for such other relief as is
agreeable to equity.
For cause of action plaintiff alleges that
on September 10th, 1886, defendant Todd recovéred judgment against suid corporation
defendant, in Department. 1 of the Superior
Courtofthe City and ounty of San Francis
co, said State, for the sum of $2709 v6-100, and
by virtue of an execution issued’ on said
judgment, directed tothe sheriff of Nevada
County, California, said Sheriffon the vth
day of Octuber, 1886, sold all of said property
in one parcel. That defendant Sweeney on
the &th. day of September, 1886, recovered a
judgment against said corporation defendant in Department 4 of the Superior Court of
said City and County of San Francisco for
$1425 64. That defendant Marshal recovered
on the “4th day of September, 1886, a judymentin Department 1 of the Superior Court,
said City and County, for $8483 55. That.
said Marshall on October 10th, 1886, purchased from suid Sweeney his said judsment,
and on the 13th day of October, 1886, paid ty
