RECITES . , tin part, in brief as follows: “The party of the first part owns certain railroad lines, equipments, rolling stocks, certain lands, franChises and other properties, which are subject to the Nien of certain mortgages and outstanding bonds, that tthe said party of the first part is justly indebted to tthe holders of said bonds for the amounts outstanding f@nd due thereon, that the party of the first part on Webruary 1, 1899, executed to the Government of the united States, Twenty promissory notes each for $2,940,635.78 maturing on or before the expiration of each successive six months after the date thereof. _ That the first party has sold to second party, subject to the lien and encumbrance of said mortgage, bonds and outstanding indebtedness, its franchises, lands and assets, and other properties.
